بشأن إصدار اللائحة التنفيذية الخاصة باستخدام النقل العام في إمارة أبوظبي

رئيس دائرة النقل:

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بشأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (13) لسنة 2016 في شأن إنشاء دائرة الشؤون البلدية والنقل،

- وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،

- وبناء على ما عرض على المجلس التنفيذي وموافقة المجلس عليه،

تقرر ما يلي:

مادة (1)

يعمل بأحكام اللائحة الخاصة باستخدام النقل العام في إمارة أبوظبي، وإلغاء أي قرار أو نص يخالف ما ورد بها من أحكام.

مادة (2)

يختص مركز النقل المتكامل بتطبيق أحكام هذه اللائحة والرقابة على الالتزام بها.

مادة (3)

يُنشر هذا القرار في الجريدة الرسمية ويعمل به اعتبارا من تاريخ نشره.

اللائحة التنفيذية الخاصة

باستخدام النقل العام في إمارة أبو ظبي

مادة (1)

في تطبيق أحكام هذه اللائحة تكون للكلمات البينة أدناه المعاني المبينة قرين كل منها ما لم يقض سياق النص خلاف ذلك:

مادة (2)

تسري أحكام هذه اللائحة على جميع مستخدمي النقل العام في الإمارة.

مادة (3)

يختص المركز بتطبيق هذه اللائحة ومتابعة الالتزام بأحكامها وعلى جميع الركاب الالتزام بالتوجيهات والإرشادات التي تصدر عن المركز فيما يتعلق باستخدام النقل العام.

مادة (4)

على الراكب الالتزام لدى استخدامه وسيلة من وسائل النقل العام بما يلي:

1. دفع أجرة النقل بوسائل السداد المتاحة التي يحددها المركز وإبراز ما يثبت ذلك للمراقب عند الطلب.

2. عدم بيع التذاكر لأي شخص آخر.

3. عدم فتح باب وسيلة النقل أو استقلالها أو الترجل منها في غير المحطات أو المواقف المخصصة لذلك.

4. عدم دخول أو إشغال أي منطقة محظورة في وسائل النقل العام أو بنيته التحتية.

5. عدم دخول أو إشغال أي منطقة أو مقاعد مخصصة لفئة معينة من الركاب ما لم ينتم إلى تلك الفئة.

6. عدم إعاقة مرور الركاب.

7. عدم تشتيت انتباه السائق أثناء القيادة.

8. عدم إساءة استخدام أي تجهيزات أو معدات خاصة بالنقل العام أو مخالفة إرشادات استعمالها مثل استخدام زر التوقف أثناء سير وسيلة النقل في غير الأحوال الموجبة.

9. عدم نقل الأمتعة التي قد تشكل إزعاجا أو أذى للركاب أو إضرارا بوسائل النقل العام أو بنيته التحتية بما فيها الأدوات الحادة والمواد القابلة للاشتعال والمواد المسكرة.

10. عدم اصطحاب الحيوانات، باستثناء "كلب المساعدة" المرخص من الجهات المختصة في الإمارة للراكب الضرير والحيوانات التي يسمح المركز بتحميلها في العبارات المائية.

11. عدم اصطحاب الدراجات الهوائية بوسائل نقل عام لا تتضمن مقصورات مخصصة لهذا الغرض.

12. عدم التسبب بأي إزعاج للآخرين أو الإتيان بأي قول أو سلوك يخدش الحياء والآداب العامة.

13. عدم المبيت في محطات النقل العام وبنيته التحتية.

14. عدم الأكل أو الشرب أو التدخين أو مضغ اللبان أو المواد التبغية وما في حكمها في الأماكن المحظورة في وسائل النقل العام وبنيته التحتية.

15. عدم البصق أو إلقاء النفايات في غير الحاويات المخصصة لذلك.

16. عدم العبث في وسائل النقل العام أو بنيته التحتية أو الإضرار بهما بما في ذلك وضع الملصقات أو المنشورات أو تعليق الأوراق إلخ.

17. عدم إخراج أي جسم من النوافذ أو الأبواب أو وضع الأقدام على المقاعد.

18. عدم استخدام أحذية وألواح بمزلاج في الأماكن المحظور استخدامها فيها.

19. الالتزام بالدور.

20. على الراكب تخزين أمتعته الشخصية وفقا للتعليمات الصادرة عن المركز الذي يجوز له رفض نقل أي أمتعة يتعذر تخزينها بشكل آمن، ولا يسمح بوضعها على المقاعد في حال عدم توفر مقاعد كافية لجلوس الركاب.

21. يتعين على مستخدمي الكراسي المتحركة تثبيتها في الأماكن المخصصة لها بأدوات التثبيت المتوفرة في وسائل النقل العام، إن وجدت، إضافة إلى تثبيت عجلاتها بالمكابح ويتوجب طيها طوال فترة الرحلة في حال عدم استخدامها.

مادة (5)

1. يعفى الأطفال دون سن العاشرة وكبار السن الذين أتموا خمسة وخمسين عاما وكذلك ذوي الاحتياجات الخاصة من أجرة استخدام وسائل النقل العام الداخلية في المدينة.

2. يمنح الطلاب من سن العاشرة فما فوق وكبار السن الذين أتموا خمسة وخمسين عاما وكذلك ذوي الاحتياجات الخاصة تخفيضا قدره 50% في أجرة استخدام وسائل النقل العام بين مدن الإمارة، وكذلك في أجرة استخدام وسائل النقل العام انطلاقا من مدن الإمارة إلى مدن الإمارات الأخرى.

3. لا يسمح بنقل أي طفل تحت سن الثانية عشر إلا بصحبة شخص بالغ في وسائل النقل العام.

مادة (6)

يلتزم الراكب بتعويض المركز عن أي أضرار يتسبب بها شخصيا أو أمتعته لوسائل النقل العام أو بنيته التحتية.

مادة (7)

لا يجوز مزاولة أي نشاط تجاري أو ترفيهي أو أي نشاط آخر من أي نوع في وسائل النقل العام أو بنيته التحتية دون تصريح من المركز، وعلى صاحب التصريح إبرازه عند الطلب.

مادة (8)

يحق للمركز رفض نقل أي راكب يعتقد أنه قد يشكل من واقع تصرفاته أو أقواله خطرا على سلامة الركاب أو خدمات النقل العام ولو كان يحمل تذكرة صالحة للرحلة.

مادة (9)

يتحمل الراكب وحده مسؤولية أي ضرر يلحق به أو بأمتعته نتيجة عدم تقيده بالتعليمات أو بالشروط والأحكام السارية على خدمات النقل العام.

مادة (10)

يتولى مراقبو المركز مهمة الرقابة والإشراف على تطبيق هذا القرار بما في ذلك مراقبة ومتابعة مستخدمي النقل العام، ولهم في سبيل ذلك ضبط المخالفات وطلب إبراز أصل الوثائق الواجب على الراكب الاحتفاظ بها أثناء الرحلة، والاستعانة بالشرطة أو أي جهة أخرى ذات اختصاص متى تطلب الأمر ذلك.

مادة (11)

مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون آخر، يطبق على المخالفين لأحكام هذه اللائحة جدول المخالفات والجزاءات المرفق بهذه اللائحة، مع سداد المخالف لقيمة إصلاح الأضرار التي تسبب بها.

يجوز للمخالف التصالح بشأن المخالفة خلال مدة (30) يوما من تاريخ ارتكابها بسداد 75% من قيمة الغرامة المحددة للمخالفة.

Decision of the Chairman of the Department No. (308) of 2017

Concerning the Issuance of the Executive Regulations for the Use of Public Transport in the Emirate of Abu Dhabi

The Chairman of the Department of Transport:

- Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments,

- And Law No. (19) of 2006 concerning the regulation of taxi transport in the Emirate of Abu Dhabi and its amendments,

- And Law No. (13) of 2016 concerning the establishment of the Department of Municipal Affairs and Transport,

- And Emiri Decree No. (13) of 2017 concerning the restructuring of the Executive Council of the Emirate of Abu Dhabi,

- And based on what was presented to the Executive Council and its approval,

Has decided the following:

Article (1)

The provisions of the regulations for the use of public transport in the Emirate of Abu Dhabi shall be enforced, and any decision or text that contradicts its provisions shall be repealed.

Article (2)

The Integrated Transport Centre shall be responsible for implementing the provisions of these regulations and monitoring compliance with them.

Article (3)

This decision shall be published in the Official Gazette and shall come into effect from the date of its publication.

Special Executive Regulations

for the Use of Public Transport in the Emirate of Abu Dhabi

Article (1)

In the application of the provisions of these regulations, the words below shall have the meanings indicated next to each, unless the context requires otherwise:

Article (2)

The provisions of these regulations shall apply to all users of public transport in the Emirate.

Article (3)

The Centre is responsible for implementing these regulations and monitoring compliance with their provisions. All passengers must adhere to the directives and instructions issued by the Centre regarding the use of public transport.

Article (4)

When using a public transport vehicle, the passenger must adhere to the following:

1. Pay the fare using available payment methods specified by the Centre and present proof upon request by the Inspector.

2. Do not sell tickets to any other person.

3. Do not open the vehicle door, board, or alight except at designated stations or stops.

4. Do not enter or occupy any restricted area in public transport vehicles or their infrastructure.

5. Do not enter or occupy any area or seats designated for a specific category of passengers unless you belong to that category.

6. Do not obstruct the passage of passengers.

7. Do not distract the driver while driving.

8. Do not misuse any public transport equipment or facilities or violate their usage instructions, such as using the stop button while the vehicle is in motion except when necessary.

9. Do not carry luggage that may cause disturbance or harm to passengers or damage to public transport vehicles or their infrastructure, including sharp tools, flammable materials, and intoxicating substances.

10. Do not bring animals, except for a "guide dog" licensed by the competent authorities in the Emirate for a blind passenger, and animals that the Centre permits on ferries.

11. Do not bring bicycles on public transport vehicles that do not have designated compartments for this purpose.

12. Do not cause any disturbance to others or engage in any speech or behavior that offends public decency and morals.

13. Do not sleep overnight in public transport stations and their infrastructure.

14. Do not eat, drink, smoke, chew gum, or use tobacco products or their equivalents in prohibited areas of public transport vehicles and their infrastructure.

15. Do not spit or litter except in designated containers.

16. Do not tamper with, damage, or deface public transport vehicles or their infrastructure, including placing stickers, posters, or hanging papers, etc.

17. Do not stick any body part out of windows or doors or place feet on seats.

18. Do not use roller skates or skateboards in areas where their use is prohibited.

19. Adhere to queuing.

20. The passenger must store their personal luggage according to the instructions issued by the Centre, which may refuse to transport any luggage that cannot be stored safely. Luggage is not allowed on seats if there are not enough seats for passengers.

21. Wheelchair users must secure their wheelchairs in the designated spaces using the fastening devices available on public transport vehicles, if any, in addition to applying the wheel brakes. Wheelchairs must be folded throughout the journey if not in use.

Article (5)

1. Children under the age of ten, senior citizens aged fifty-five and over, and people of determination are exempt from the fare for using internal public transport within the city.

2. Students aged ten and above, senior citizens aged fifty-five and over, and people of determination are granted a 50% discount on the fare for using public transport between the cities of the Emirate, as well as on the fare for using public transport from the cities of the Emirate to the cities of other Emirates.

3. No child under the age of twelve is allowed to travel on public transport unless accompanied by an adult.

Article (6)

The passenger is obliged to compensate the Centre for any damage caused by them or their luggage to public transport vehicles or their infrastructure.

Article (7)

It is not permitted to conduct any commercial, recreational, or any other type of activity in public transport vehicles or their infrastructure without a permit from the Centre. The permit holder must present it upon request.

Article (8)

The Centre has the right to refuse to transport any passenger who, based on their actions or words, is believed to pose a risk to the safety of passengers or public transport services, even if they hold a valid ticket for the journey.

Article (9)

The passenger alone bears the responsibility for any harm to themselves or their luggage resulting from their failure to comply with the instructions or the terms and conditions applicable to public transport services.

Article (10)

The Centre's inspectors shall be responsible for supervising and monitoring the implementation of this decision, including monitoring and following up with public transport users. In doing so, they may record violations, request the presentation of original documents that the passenger must keep during the journey, and seek assistance from the police or any other competent authority when necessary.

Article (11)

Without prejudice to any more severe penalty stipulated by another law, violators of the provisions of these regulations shall be subject to the schedule of violations and penalties attached to these regulations, in addition to the violator paying the cost of repairing the damages they caused.

The violator may settle the violation within a period of (30) days from the date of its commission by paying 75% of the value of the fine specified for the violation.
