بتعديل بعض أحكام اللائحة التنفيذية رقم (22) لسنة 2019
بشأن التعرفة المرورية في إمارة أبو ظبي
رئيس دائرة البلديات والنقل:
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (17) لسنة 2017 بشأن التعرفة المرورية في إمارة أبوظبي ولائحته التنفيذية،
- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- وبناءً على ما عرض على المجلس التنفيذي وموافقة المجلس عليه،
قرر الآتي:
المادة (1)
تُعدل أحكام اللائحة التنفيذية رقم (22) لسنة 2019 بشأن التعرفة المرورية في إمارة أبوظبي وذلك وفقًا للمرفق بهذا القرار.
المادة (2)
تكون الفترة من 15 أكتوبر 2019 إلى 1 يناير 2020 فترة تجريبية لنظام التعرفة المرورية مع عدم احتساب أية رسوم خلال هذه الفترة، على أن يتم البدء بتحصيل رسوم التعرفة المرورية اعتبارًا من تاريخ 2 يناير 2020.
المادة (3)
يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.
المادة (4)
ينفذ هذا القرار من تاريخ صدوره وينشر في الجريدة الرسمية.

بشأن التعرفة المرورية في إمارة أبوظبي
المادة (1)
تضاف التعريفات التالية إلى المادة (1) بحيث تقرأ كالآتي:
| أصحاب الهمم |
: |
أي شخص يحمل بطاقة أصحاب الهمم التي تصدرها الجهة المختصة. |
| ذوي الدخل المحدود من المواطنين |
: |
أي مواطن تنطبق عليه الشروط التي تحددها الجهات المختصة بدعم ذوي الدخل المحدود في الدولة. |
| كبار المواطنين |
: |
أي مواطن يبلغ سنه 60 سنة ميلادية أو أكثر. |
| المواطنون المتقاعدون |
: |
أي مواطن ينطبق عليه تعريف المتقاعد المعتمد لدى الجهة المختصة في الدولة. |
| مركبات الأفراد |
: |
هي السيارة الخاصة المعدة للاستعمال الشخصي لنقل الركاب ومستلزماتهم الشخصية فقط. |
| الجهة المختصة |
: |
الجهة الحكومية التي ترتبط بإجراءاتها ومهامها مع الإجراءات والمهام الخاصة بتنفيذ هذا القرار. |
المادة (2)
- تستبدل المادة (3) بحيث تقرأ على النحو الآتي:
1. يستوفي المركز التعرفة المرورية وفق جدول الرسوم الوارد بالمادة (6) من هذا المرفق عن كل مركبة تعبر أي من مناطق التعرفة المرورية للمرة الواحدة.
2. يكون تحصيل التعرفة المرورية عبر بوابات التعرفة خلال أوقات الذروة فقط حسب جدول الرسوم الوارد بالمادة (6) من هذا المرفق.
3. يكون السقف الأعلى للرسوم اليومية على مركبات الأفراد (16) درهم يوميًا.
المادة (3)
تضاف مادة جديدة بالرقم (3) مكرر على النحو الآتي:
1. يكون السقف الأعلى للرسوم الشهرية على مركبات الأفراد (للمالك الواحد) وفقًا لما يلي:
- (200) درهم للمركبة الأولى.
- (150) درهم للمركبة الثانية.
- (100) درهم عن كل مركبة إضافية.
2. وفقًا لما يحدده نظام التعرفة المرورية إلكترونيًا من حيث بلوغ المركبة لسقف رسوم التعرفة الشهري وفقًا لهذه المادة.
3. في حال تم استثناء إحدى مركبات الأفراد، يتم تطبيق السقف الشهري على المركبات المتبقية.
المادة (4)
- يضاف إلى المادة (10) البند التالي:
- يكون التسجيل في النظام ملزمًا لجميع المستخدمين شاملاً مستحقي الإعفاءات ويتم إعفائهم من رسوم التسجيل والتعرفة المرورية.
المادة (5)
1. يعدل البند رقم 4 من الجدول رقم (4) المرفق باللائحة فيما يخص المركبات المستثناة من تطبيق التعرفة المرورية ليصبح على النحو الآتي:

Amending Some Provisions of the Executive Regulation No. (22) of 2019
Concerning the Traffic Tariff in the Emirate of Abu Dhabi
The Chairman of the Department of Municipalities and Transport:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (19) of 2006 concerning the Regulation of Taxi Transport in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (17) of 2017 concerning the Traffic Tariff in the Emirate of Abu Dhabi and its executive regulations,
- And Law No. (30) of 2019 concerning the Establishment of the Department of Municipalities and Transport,
- And based on what was presented to the Executive Council and its approval,
Has decided the following:
Article (1)
The provisions of Executive Regulation No. (22) of 2019 concerning the Traffic Tariff in the Emirate of Abu Dhabi shall be amended in accordance with the appendix attached to this decision.
Article (2)
The period from October 15, 2019, to January 1, 2020, shall be a trial period for the traffic tariff system, with no fees being charged during this period. The collection of traffic tariff fees shall commence from January 2, 2020.
Article (3)
Any text or provision that contradicts or conflicts with the provisions of this decision shall be repealed.
Article (4)
This decision shall be effective from the date of its issuance and shall be published in the Official Gazette.

Appendix to Administrative Decision No. (45) of 2019
Amending Some Provisions of the Executive Regulation No. (22) of 2019
Concerning the Traffic Tariff in the Emirate of Abu Dhabi
Article (1)
The following definitions shall be added to Article (1) to read as follows:
| People of Determination |
: |
Any person holding a People of Determination card issued by the competent authority. |
| Low-income nationals |
: |
Any national who meets the conditions specified by the competent authorities for supporting low-income individuals in the state. |
| Senior nationals |
: |
Any national who is 60 Gregorian years of age or older. |
| Retired nationals |
: |
Any national to whom the definition of a retiree approved by the competent authority in the state applies. |
| Private vehicles |
: |
A private car intended for personal use for transporting passengers and their personal belongings only. |
| Competent Authority |
: |
The government entity whose procedures and tasks are linked with the procedures and tasks related to the implementation of this decision. |
Article (2)
- Article (3) shall be replaced to read as follows:
1. The Center shall collect the traffic tariff according to the fee schedule in Article (6) of this appendix for each vehicle that crosses any of the traffic tariff zones a single time.
2. The traffic tariff shall be collected through the toll gates during peak hours only, according to the fee schedule in Article (6) of this appendix.
3. The maximum daily fee cap for private vehicles shall be (16) AED per day.
Article (3)
A new article, number (3) bis, shall be added as follows:
1. The maximum monthly fee cap for private vehicles (per owner) shall be as follows:
- (200) AED for the first vehicle.
- (150) AED for the second vehicle.
- (100) AED for each additional vehicle.
2. According to what is electronically determined by the traffic tariff system regarding the vehicle reaching the monthly tariff fee cap in accordance with this article.
3. If one of the private vehicles is exempted, the monthly cap shall be applied to the remaining vehicles.
Article (4)
- The following clause shall be added to Article (10):
- Registration in the system shall be mandatory for all users, including those eligible for exemptions, and they shall be exempt from registration and traffic tariff fees.
Article (5)
1. Clause No. 4 of Schedule No. (4) attached to the regulation concerning vehicles exempted from the traffic tariff shall be amended to become as follows:
