بشأن اللائحة التنفيذية الخاصة بتشغيل خدمات نقل الركاب بالحافلات
في إمارة أبوظبي
رئيس دائرة البلديات والنقل:
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- وعلى قرار رئيس دائرة الشؤون البلدية والنقل رقم (259) لسنة 2017 بشأن إصدار اللائحة التنفيذية الخاصة بتنظيم خدمة النقل المدرسي في إمارة أبوظبي،
- وبناء على ما عرض على المجلس التنفيذي وموافقة المجلس عليه.
تقرر الآتي:
المادة (1)
التعريفات
في تطبيق أحكام هذه اللائحة تكون للكلمات والعبارات التالية، المعاني الموضحة قرين كل منها ما لم يدل سياق النص على خلاف ذلك:
| الإمارة | : إمارة أبوظبي. |
| الدائرة | : دائرة البلديات والنقل. |
| المركز | : مركز النقل المتكامل. |
| الحافلة | : المركبة التي تزيد سعتها على 9 ركاب بمن فيهم السائق حسب تصنيف المصنع. |
| الحافلات العامة | : حافلات يشغلها المركز أو إحدى الجهات المصرح لها من قبله أو المتعاقدة معها، معدة للنقل الجماعي العام للأشخاص وفق تعرفة وخطوط خدمة محددة داخل الإمارة ومنها إلى خارجها. |
| الحافلة السياحية | : الحافلة مرخصة كحافلة سياحية من سلطة الترخيص لاستخدامها في نشاط النقل السياحي. |
| الحافلة الخاصة | : الحافلة مسجلة في الإمارة بناء على تصريح من قبل المركز لنقل موظفي وعمال ومتعاملي المنشأة المالكة. |
| نقل الركاب بالحافلة المؤجرة | : نقل عمال ومستخدمي ومتعاملي المنشآت والمراكز التجارية والسياحية وشركات المقاولات وغيرها من المنشآت بناء على عقود موقعة بين تلك الجهات ومشغل الحافلة المؤجرة لهذا الغرض. |
| التعرفة | : الأجرة المحددة نظير استخدام إحدى الحافلات العامة. |
| المشغل | : الشركة أو المؤسسة الفردية المصرح لها من قبل المركز لتشغيل وتقديم إحدى أو بعض أنشطة نقل الركاب بالحافلات في الإمارة. |
| تصريح مزاولة نشاط | : التصريح الصادر عن المركز لمزاولة إحدى أنشطة نقل الركاب بالحافلات. |
| تصريح مزاولة مهنة | : التصريح الصادر عن المركز لقيادة فئة معينة من الحافلات محددة في التصريح. |
| النشاط | : أي من أنشطة نقل الركاب بالحافلات التي يتم مزاولتها انطلاقا من الإمارة، وفقًا للقرارات التي تصدرها الدائرة. |
| سلطة الترخيص | : السلطة المعنية بترخيص المركبات في الإمارة. |
| علامات الخدمة | : العلامات التي تميز إحدى خدمات نقل الركاب بالحافلات، سواء كانت مسجلة أو غير مسجلة لدى الجهات المعنية، أو الشعارات أو العبارات الخاصة بالخدمات، لون الحافلة المميز لكل خدمة الزي الموحد للسائقين وغير ذلك مما هو في هذا المجال. |
| اتفاقية الامتياز | : الاتفاقية المعتمدة من رئيس الدائرة والتي يعهد المركز بموجبها للمشغل بمزاولة نشاط نقل الركاب بالحافلات العامة. |
المادة (2)
تسري أحكام هذه اللائحة على مشغلي نقل الركاب بالحافلات في الإمارة وعلى الحافلات المسجلة خارج الإمارة والمشغلة فيها.
المادة (3)
يختص المركز بتطبيق أحكام هذه اللائحة والرقابة على الالتزام بها وله أن يباشر المركز الاختصاصات التالية:
- التصريح بتسجيل جميع الحافلات في الإمارة، وإنشاء قواعد بيانات خاصة بها بالتنسيق مع سلطة الترخيص.
- تشغيل خطوط الحافلات العامة داخل الإمارة، وبينها وبين الإمارات الأخرى.
- التعاقد مع الغير لتوفير خدمات الحافلات العامة بعد اعتماد الدائرة، ورفع تقارير دورية عن كفاءة وفعالية وسلامة وجودة الخدمات.
- التصريح بمزاولة أنشطة نقل الركاب بالحافلات في الإمارة، ومنها باتجاه الإمارات الأخرى.
- إصدار تصاريح مزاولة المهنة لسائقي الحافلات العامة والنقل السياحي.
- مراقبة مدى التزام المشغلين بشروط التصاريح الممنوحة لهم والعقود المبرمة معهم.
- إنشاء قواعد بيانات، وإعداد الدراسات المتخصصة في تطوير وتحسين الأنشطة في الإمارة ورفعها إلى الدائرة.
- إعداد النماذج والأدلة والمواصفات والمعايير الفنية والسياسات التشغيلية ومنهجيات العمل للحافلات ورفعها إلى الدائرة للاعتماد.
المادة (4)
يشترط لمزاولة النشاط، الالتزام بما يلي:
- الحصول على تصريح تشغيل من المركز والالتزام بحدود التصريح الممنوح له قبل بدء عمليات التشغيل.
- الحصول من المركز على تصريح لتسجيل الحافلة أو تجديد أو نقل ملكيتها أو شطبها لدى سلطة الترخيص.
- عدم تشغيل الحافلات لمدة تتجاوز العمر الذي يحدده المركز حسب اشتراطاته بحيث لا تتجاوز عشر سنوات من سنة الصنع في كافة الأحوال، ويجوز زيادة هذه المدة سنة فأخرى بعد اجتيازها الفحص الفني المقرر لهذا الغرض من قبل المركز.
- توفير تأمين يغطي السائق والركاب.
- الالتزام بتوفير آلية لتقديم الشكاوى والمقترحات والملاحظات والاحتفاظ بسجلات الشكاوى متضمنة تفاصيل الشكوى ومقدمها ووقتها وتاريخها وموقعها والإجراءات المتخذة حيالها باستثناء مشغلي الحافلات الخاصة.
- عرض جميع القواعد والشروط المتعلقة باستخدام الحافلة والإجراءات الواجب اتباعها في حالات الطوارئ في مكان بارز يسهل على الركاب الاطلاع عليها.
- الالتزام بالتسجيل في نظام إدارة السلامة والصحة المهنية بموجب متطلبات مركز أبوظبي للصحة العامة خلال فترة 30 يومًا من التصريح و/ أو تجديد التصريح.
- وضع برامج مفصلة للصيانة الدورية للحافلات متضمنة إجراءات الفحص اليومي لها والتأكد من نظافتها الداخلية والخارجية والاحتفاظ بسجلاتها واطلاع المركز عليها عند الطلب والالتزام بتنفيذها.
- عدم إشغال مداخل الحافلات ومخارجها وممراتها بما في ذلك مخارج الطوارئ بأي عوائق أو مقاعد أثناء التشغيل.
- توفير الزي الموحد لسائقي الحافلات المشغلة وإلزامهم بارتدائه وتثبيت تصريح مزاولة المهنة على الصدر أثناء تأدية عملهم حسب الأدلة المعتمدة.
- تسليم الأمتعة المتروكة في حافلات أو منشآت المشغل إلى أقرب مركز شرطة فور العثور عليها وإشعار المركز بذلك وفق الآلية التي يحددها لذلك.
- الالتزام بعلامات الخدمة التي يحددها المركز لكل نشاط وعدم استخدام أي من تلك العلامات أو أية علامات أخرى على الحافلات قبل الحصول على موافقة من المركز.
- إزالة علامات الخدمة عن الحافلات عند انتهاء سريان تصريح مزاولة النشاط أو في حال بيعها أو شطبها أو استخدامها في أي نشاط غير النشاط المصرح به.
- ربط الحافلات بنظام مراقبة أو تتبع إلكتروني يقرره المركز.
- التأكد من توافق أنظمة النقل الذكية مع المعايير والمواصفات المعتمدة من الدائرة.
- استخدام الحافلة في النشاط المرخص به حصرًا.
- عدم استخدام اللون المخصص للحافلات العامة والنقل المدرسي من قبل حافلات نقل الركاب الخاصة أو السياحية الأخرى.
- عدم وضع أي كتابات أو إعلانات على الهيكل الخارجي للحافلة إلا بموافقة المركز.
- الاحتفاظ بسجلات منتظمة تبين عدد ساعات عمل السائقين وساعات القيادة وساعات الاستراحة وذلك باستخدام أجهزة تقنية معتمدة من المركز.
- إيقاف الحافلات في الأماكن المصرح لها.
- توفير البيانات والمعلومات والتقارير والوثائق التي يتم طلبها من الدائرة أو المركز خلال المدة الزمنية المحددة في الطلب.
- التقيد بالاشتراطات والتعليمات التي تصدرها الدائرة أو المركز.
المادة (5)
تشغيل نشاط نقل الركاب بالحافلات العامة
يتوجب لتوفير خدمة النقل بالحافلات العامة الالتزام بما يلي:
- التوقيع مع المركز على اتفاقية تشغيل أو امتياز بحسب المقتضى والتقيد بالاشتراطات والمعايير والمواصفات المنصوص عليها في تلك الاتفاقيات وكذلك التشريعات المنظمة للنشاط.
- الحصول على تصريح مزاولة المهنة من المركز للسائق لفئة الحافلة التي يعمل عليها.
- سداد الرسوم المقررة لخدمة تشغيل نشاط النقل بالحافلات العامة المعتمدة في الإمارة.
- التعرفة المعتمدة في الإمارة لنقل الركاب وأمتعتهم.
المادة (6)
تصريح مزاولة المهنة
-
يحظر على أي شخص قيادة أي حافلة عامة أو سياحية ما لم يكن حاصلاً على تصريح بذلك من المركز، ويشترط لمنح هذا التصريح ما يلي:
أ- أن يكون حاصلاً على رخصة قيادة حسب نوع الحافلة المراد قيادتها.
ب- أن يجتاز الدورات التدريبية التي يحددها المركز.
ت- ألا يقل عمره عن (25) سنة.
ث- أن يقدم شهادة حسن سيرة وسلوك صادرة من القيادة العامة لشرطة أبوظبي للمقيمين داخل الدولة، أو من الدولة المستقدمين منها للقادمين من الخارج على أن تكون مصدقة أصولاً وألا يكون قد مضى على صدورها أكثر من شهر واحد قبل تاريخ تقديم الطلب.
ج- توفير تقرير النقاط المرورية من الجهة المعنية عن السنة التي يتم فيها تقديم الطلب والسنة السابقة لها.
ح- أن يقدم تقريرًا طبيًا كل سنتين يؤكد خلوه من الأمراض التالية:
- الإعاقة.
- أمراض القلب والسكري والضغط ذات الخطورة المرتفعة.
- الصرع والأمراض العقلية والعصبية والنفسية.
- أمراض الكلى والكبد الوبائي.
- الجذام.
- أمراض النظر وقوة الإبصار وضعف السمع.
خ- أن يكون ملمًا باللغة العربية أو الإنجليزية.
د- أن يجتاز الاختبارات التي يجريها المركز.
المادة (7)
أحكام عامة
- تكون مدة سريان تصاريح مزاولة النشاط الصادرة من المركز سنة واحدة.
- تكون مدة سريان تصريح الحافلة الصادر من المركز سنة واحدة قابلة للتجديد.
- يجب على المشغل تجديد تصريح مزاولة النشاط قبل انتهاء مدة صلاحيته ويعتبر التصريح لاغياً بعد مضي شهر من تاريخ انتهائه.
- تحدد مدة صلاحية تصريح مزاولة المهنة بسنتين قابلة للتجديد لمدد مماثلة، ولا يجوز للسائق قيادة أي حافلة بتصريح منتهي الصلاحية.
- يجب تجديد تصريح مزاولة المهنة خلال شهر من تاريخ انتهائه ويعتبر التصريح لاغياً بمضي شهر من تاريخ انتهائه.
- يجوز للمركز إيقاف العمل بأي تصريح أو إلغائه عند انتفاء أي من المتطلبات والشروط المقررة بموجب هذه اللائحة وكذلك في حال ثبوت عدم صحة البيانات المقدمة للحصول على التصريح، أو في حال تراكم المخالفات لمدة 6 شهور من تاريخ المخالفة.
- لا يجوز تجديد تصاريح مزاولة النشاط وتصاريح مزاولة المهنة إلا بعد سداد الغرامات المقررة والمخالفات، وعلى المشغل أن يسلم إلى المركز تصريح أي سائق عند انتهاء عمله لديه.
- في حال توجيه اتهام لأي سائق حافلة عامة أو سياحية بارتكاب جريمة مخلة بالشرف أو الأمانة أو أدين بجريمة القيادة تحت تأثير المسكرات أو المخدرات والمؤثرات العقلية يتم على الفور إيقاف العمل بتصريح مزاولة المهنة الصادر له وإعادته للمركز إلى أن يصدر الحكم النهائي في حقه، فإذا صدر الحكم بإدانته أو تسبب بحادث جسيم فيتم إلغاء التصريح ولا يصرح له بمزاولة المهنة مرة أخرى.
المادة (8)
بالإضافة إلى المواصفات والمعايير الأخرى الخاصة بالحافلات والتي يصدر بتحديدها قرار من رئيس الدائرة، يجب أن تتطابق جميع الحافلات التي يتم تسجيلها أو تشغيلها في الإمارة مع المواصفات القياسية الإماراتية المعتمدة والحصول على شهادة المطابقة الخليجية.
المادة (9)
يجب على المشغل المصرح له مزاولة نشاط نقل الركاب بالحافلات المؤجرة توفير نسخة من العقد الموقع بينه وبين مستأجر الخدمة للمصادقة عليه من قبل المركز قبل المباشرة في توفير الخدمة لذلك المستأجر، وتحديد مسار ونقاط تحميل وتنزيل للركاب داخل الإمارة.
المادة (10)
- يحظر تشغيل أية حافلة بما في ذلك الحافلات الخاصة في الإمارة لمزاولة أي نشاط دون الحصول على تصريح من المركز.
- يحظر تشغيل أي حافلة بما في ذلك الحافلات الخاصة لمزاولة النشاط ما لم تكن مسجلة في الإمارة ويجوز للمركز التصريح للحافلات من خارج الإمارة بالتشغيل حسب الاشتراطات المعتمدة.
- يحظر تشغيل أية حافلة بما في ذلك الحافلات الخاصة غير المكيفة وغير المطابقة للمواصفات والمعايير المعتمدة من الدائرة.
المادة (11)
- مع عدم الإخلال بأية عقوبة أشد منصوص عليها في أي تشريع آخر، يطبق على المخالفين لأحكام هذه اللائحة جدول المخالفات والغرامات الملحق بها.
- على المركز إبلاغ سلطات الترخيص المختصة في الإمارة بكافة المخالفات التي لم تسدد غراماتها والتنسيق معها لتحصيل قيمة الغرامات.
المادة (12)
- يتولى مأمور الضبط القضائي للمركز مهمة مراقبة تنفيذ أحكام هذه اللائحة، ولهم في سبيل تنفيذ ذلك ضبط المخالفات وطلب إبراز الوثائق اللازمة كما يجوز لهم الاستعانة بالشرطة أو أي جهة أخرى ذات اختصاص متى تطلب الأمر.
- على مأمور الضبط القضائي المختص عند تحرير المحضر أن يعرض التصالح على المخالف، ويثبت ذلك في المحضر.
- على المخالف الذي يقبل التصالح أن يسدد 75% من إجمالي الغرامة المحددة للمخالفة، في مهلة لا تتجاوز ستين (60) يومًا من تاريخ عرض التصالح عليه، وتنقضي المخالفة بالتصالح.
المادة (13)
يجوز لكل ذي مصلحة التظلم خطيًا للمركز من أي قرار أو إجراء أو تدبير اتخذ بحقه بمقتضى أحكام هذه اللائحة والقرارات الصادرة بموجبها، خلال ستين (60) يومًا من تاريخ إخطاره بالقرار أو الإجراء أو التدبير المتظلم منه، ويتم البت في التظلم وفق الإجراءات المتبعة في المركز ويخطر المتظلم بنتيجة تظلم، ويعتبر عدم البت في التظلم خلال تسعين يومًا (90) من تاريخ تقديمه بمثابة قبول للتظلم.
المادة (14)
على جميع مشغلي أنشطة نقل الركاب بالحافلات توفيق أوضاعهم طبقًا لأحكام هذه اللائحة خلال مدة لا تزيد على سنة من تاريخ العمل بها.
المادة (15)
ينشر هذا القرار في الجريدة الرسمية، ويعمل به بعد ثلاثة أشهر من تاريخ نشره.

Decision of the Chairman of the Department of Municipalities and Transport No. (33) of 2021
Concerning the Executive Regulations for the Operation of Bus Passenger Transport Services
in the Emirate of Abu Dhabi
The Chairman of the Department of Municipalities and Transport:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (19) of 2006 concerning the Regulation of Taxi Transport in the Emirate of Abu Dhabi and its amendments,
- And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport,
- And the Decision of the Chairman of the Department of Municipal Affairs and Transport No. (259) of 2017 on the Issuance of the Executive Regulations for the Regulation of School Transport Service in the Emirate of Abu Dhabi,
- And based on what was presented to the Executive Council and its approval.
Has decided the following:
Article (1)
Definitions
In the application of the provisions of these regulations, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
| The Emirate | : The Emirate of Abu Dhabi. |
| The Department | : The Department of Municipalities and Transport. |
| The Center | : The Integrated Transport Centre. |
| The Bus | : A vehicle with a capacity exceeding 9 passengers, including the driver, according to the manufacturer's classification. |
| Public Buses | : Buses operated by the Center or one of its authorized or contracted entities, intended for public mass transit of persons according to a specific tariff and service routes within and outside the Emirate. |
| Tourist Bus | : A bus licensed as a tourist bus by the Licensing Authority for use in tourist transport activities. |
| Private Bus | : A bus registered in the Emirate based on a permit from the Center to transport the employees, workers, and clients of the owning establishment. |
| Rented Bus Passenger Transport | : Transporting workers, users, and clients of establishments, commercial and tourist centers, contracting companies, and other establishments based on contracts signed between those entities and the operator of the bus rented for this purpose. |
| The Tariff | : The specified fare for using a public bus. |
| The Operator | : A company or sole proprietorship authorized by the Center to operate and provide one or more bus passenger transport activities in the Emirate. |
| Activity Permit | : The permit issued by the Center to practice one of the bus passenger transport activities. |
| Profession Permit | : The permit issued by the Center to drive a specific category of buses specified in the permit. |
| The Activity | : Any of the bus passenger transport activities practiced originating from the Emirate, in accordance with the decisions issued by the Department. |
| Licensing Authority | : The authority concerned with vehicle licensing in the Emirate. |
| Service Marks | : The marks that distinguish a bus passenger transport service, whether registered or not with the concerned authorities, or logos or phrases specific to the services, the distinctive bus color for each service, the unified uniform for drivers, and other related matters. |
| Concession Agreement | : The agreement approved by the Chairman of the Department, under which the Center entrusts the Operator with the activity of public bus passenger transport. |
Article (2)
The provisions of these regulations shall apply to operators of bus passenger transport in the Emirate and to buses registered outside the Emirate and operated within it.
Article (3)
The Center is responsible for applying the provisions of these regulations and monitoring compliance with them, and it may exercise the following competencies:
- Authorizing the registration of all buses in the Emirate, and establishing special databases for them in coordination with the Licensing Authority.
- Operating public bus routes within the Emirate, and between it and other Emirates.
- Contracting with third parties to provide public bus services after the Department's approval, and submitting periodic reports on the efficiency, effectiveness, safety, and quality of services.
- Authorizing the practice of bus passenger transport activities in the Emirate, and from it towards other Emirates.
- Issuing profession permits for drivers of public and tourist transport buses.
- Monitoring the extent of operators' compliance with the conditions of the permits granted to them and the contracts concluded with them.
- Establishing databases, and preparing specialized studies for the development and improvement of activities in the Emirate and submitting them to the Department.
- Preparing forms, manuals, specifications, technical standards, operational policies, and work methodologies for buses and submitting them to the Department for approval.
Article (4)
To practice the activity, the following must be adhered to:
- Obtaining an operating permit from the Center and adhering to the limits of the permit granted before starting operations.
- Obtaining a permit from the Center to register, renew, transfer ownership of, or deregister a bus with the Licensing Authority.
- Not operating buses for a period exceeding the age limit determined by the Center according to its requirements, provided that it does not exceed ten years from the year of manufacture in all cases. This period may be extended year by year after passing the technical inspection prescribed for this purpose by the Center.
- Providing insurance that covers the driver and passengers.
- Committing to providing a mechanism for submitting complaints, suggestions, and feedback, and maintaining records of complaints including the details of the complaint, the complainant, its time, date, location, and the actions taken, with the exception of private bus operators.
- Displaying all rules and conditions related to the use of the bus and the procedures to be followed in emergencies in a prominent place easily accessible to passengers.
- Committing to registering in the Occupational Safety and Health Management System according to the requirements of the Abu Dhabi Public Health Center within a period of 30 days from the permit issuance and/or renewal.
- Developing detailed programs for the periodic maintenance of buses, including daily inspection procedures, ensuring their internal and external cleanliness, maintaining their records, making them available to the Center upon request, and committing to their implementation.
- Not obstructing bus entrances, exits, and aisles, including emergency exits, with any obstacles or seats during operation.
- Providing a unified uniform for operating bus drivers and obliging them to wear it and display the profession permit on their chest while on duty, according to the approved guidelines.
- Handing over luggage left in buses or the operator's facilities to the nearest police station immediately upon finding it and notifying the Center according to the mechanism it specifies.
- Adhering to the service marks specified by the Center for each activity and not using any of those marks or any other marks on buses without obtaining approval from the Center.
- Removing service marks from buses upon the expiry of the activity permit, or in case of their sale, deregistration, or use in any activity other than the permitted one.
- Connecting buses to an electronic monitoring or tracking system determined by the Center.
- Ensuring that intelligent transport systems comply with the standards and specifications approved by the Department.
- Using the bus exclusively for the licensed activity.
- Not using the color designated for public and school transport buses by other private or tourist passenger transport buses.
- Not placing any writings or advertisements on the external body of the bus without the Center's approval.
- Maintaining regular records showing the number of drivers' working hours, driving hours, and rest hours, using technical devices approved by the Center.
- Parking buses in authorized places.
- Providing the data, information, reports, and documents requested by the Department or the Center within the time frame specified in the request.
- Adhering to the requirements and instructions issued by the Department or the Center.
Article (5)
Operation of Public Bus Passenger Transport Activity
To provide public bus transport service, the following must be adhered to:
- Signing an operation or concession agreement with the Center, as appropriate, and adhering to the requirements, standards, and specifications stipulated in those agreements, as well as the legislation regulating the activity.
- Obtaining a profession permit from the Center for the driver for the category of bus they operate.
- Paying the prescribed fees for the operation of public bus transport service approved in the Emirate.
- The approved tariff in the Emirate for the transport of passengers and their luggage.
Article (6)
Profession Permit
-
No person is allowed to drive any public or tourist bus unless they hold a permit to do so from the Center. The conditions for granting this permit are as follows:
a- Must hold a driving license corresponding to the type of bus to be driven.
b- Must pass the training courses specified by the Center.
c- Must not be less than (25) years of age.
d- Must provide a certificate of good conduct issued by the Abu Dhabi Police General Headquarters for residents within the country, or from their country of origin for those coming from abroad, duly attested and issued no more than one month before the date of application.
e- Provide a traffic points report from the concerned authority for the year in which the application is submitted and the preceding year.
f- Must submit a medical report every two years confirming freedom from the following diseases:
- Disability.
- High-risk heart disease, diabetes, and hypertension.
- Epilepsy, mental, neurological, and psychological diseases.
- Kidney diseases and hepatitis.
- Leprosy.
- Vision and eyesight disorders and hearing impairment.
g- Must be proficient in Arabic or English.
h- Must pass the tests conducted by the Center.
Article (7)
General Provisions
- The validity period of activity permits issued by the Center is one year.
- The validity period of the bus permit issued by the Center is one year, renewable.
- The operator must renew the activity permit before its expiry date. The permit is considered void after one month from its expiry date.
- The validity period of the profession permit is two years, renewable for similar periods. A driver is not allowed to drive any bus with an expired permit.
- The profession permit must be renewed within one month of its expiry date. The permit is considered void after one month from its expiry date.
- The Center may suspend or cancel any permit if any of the requirements and conditions stipulated in these regulations are no longer met, if the data submitted to obtain the permit is proven to be incorrect, or if fines accumulate for a period of 6 months from the date of the violation.
- Activity permits and profession permits cannot be renewed until all prescribed fines and violations are paid. The operator must surrender to the Center the permit of any driver upon the termination of their employment.
- If any public or tourist bus driver is accused of a crime against honor or trust, or is convicted of driving under the influence of alcohol, drugs, or psychotropic substances, the profession permit issued to them shall be immediately suspended and returned to the Center until a final judgment is issued. If convicted or causes a serious accident, the permit will be canceled, and they will not be permitted to practice the profession again.
Article (8)
In addition to the other specifications and standards for buses, which are determined by a decision from the Chairman of the Department, all buses registered or operated in the Emirate must conform to the approved UAE standard specifications and obtain the Gulf Conformity Certificate.
Article (9)
The operator authorized to practice the activity of rented bus passenger transport must provide a copy of the contract signed between it and the service lessee for authentication by the Center before commencing the provision of service to that lessee, and specify the route and loading and unloading points for passengers within the Emirate.
Article (10)
- It is prohibited to operate any bus, including private buses, in the Emirate for any activity without obtaining a permit from the Center.
- It is prohibited to operate any bus, including private buses, for the activity unless it is registered in the Emirate. The Center may permit buses from outside the Emirate to operate according to the approved requirements.
- It is prohibited to operate any bus, including private buses, that is not air-conditioned or does not conform to the specifications and standards approved by the Department.
Article (11)
- Without prejudice to any more severe penalty stipulated in any other legislation, the schedule of violations and fines attached hereto shall be applied to violators of the provisions of these regulations.
- The Center must inform the competent licensing authorities in the Emirate of all violations for which fines have not been paid and coordinate with them to collect the value of the fines.
Article (12)
- The judicial officers of the Center shall be responsible for monitoring the implementation of the provisions of these regulations. In carrying out this duty, they may record violations and request the presentation of necessary documents. They may also seek assistance from the police or any other competent authority when required.
- The competent judicial officer, when issuing a report, shall offer a settlement to the violator and record this in the report.
- A violator who accepts the settlement must pay 75% of the total fine specified for the violation within a period not exceeding sixty (60) days from the date the settlement was offered. The violation is extinguished by settlement.
Article (13)
Any interested party may submit a written grievance to the Center against any decision, action, or measure taken against them under the provisions of these regulations and the decisions issued thereunder, within sixty (60) days from the date of notification of the decision, action, or measure being grieved. The grievance shall be decided upon in accordance with the procedures followed at the Center, and the grievant shall be notified of the outcome of their grievance. Failure to decide on the grievance within ninety (90) days from the date of its submission shall be considered an acceptance of the grievance.
Article (14)
All operators of bus passenger transport activities must regularize their status in accordance with the provisions of these regulations within a period not exceeding one year from the date of its entry into force.
Article (15)
This decision shall be published in the Official Gazette and shall come into force three months after the date of its publication.
