في شأن اللائحة التنفيذية لقانون التعرفة المرورية في إمارة أبوظبي
رئيس دائرة النقل:
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- - وعلى قانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (17) لسنة 2017 بشأن التعرفة المرورية.
- - وعلى القانون رقم (6) لسنة 2018 بشأن إنشاء دائرة النقل.
- - وعلى قرار رئيس المجلس التنفيذي رقم (21) لسنة 2018 بشأن اختصاصات إضافية لدائرة النقل.
- - وبناء على ما عرض على المجلس التنفيذي وموافقة المجلس عليه.
تقرر ما يلي:
مادة (1)
يعمل بأحكام اللائحة التنفيذية لقانون التعرفة المرورية في إمارة أبوظبي المرفقة بهذا القرار.
مادة (2)
ينشر هذا القرار في الجريدة الرسمية ويعمل به اعتباراً من تاريخ نشره.

اللائحة التنفيذية للقانون رقم (17) لسنة 2017 بشأن التعرفة المرورية في إمارة أبوظبي
مادة (1)
تكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها ما لم يدل سياق النص على خلاف ذلك:

مادة (2)
تكون مناطق تطبيق نظام التعرفة المرورية في الإمارة كما هي محددة في الجدول رقم (1) المرفق بهذه اللائحة.
للدائرة تعديل أو إضافة مناطق تطبيق التعرفة المرورية بعد موافقة المجلس التنفيذي.
مادة (3)
يستوفي المركز التعرفة المرورية وفق جدول الرسوم والتعرفة المعتمد من المجلس التنفيذي عن كل مركبة تعبر أي من مناطق التعرفة المرورية بالاتجاهين.
- يكون تحصيل التعرفة المرورية عبر بوابات التعرفة على مدار الساعة خلال جميع أيام السنة وعلى ألا يتجاوز 16 درهماً لكل مركبة في اليوم الواحد.
مادة (4)
- - ينشئ المركز نظاماً إلكترونياً للتعرفة المرورية يتيح فتح الحسابات ويمكن المستخدمين من إدارة حساباتهم.
- - يتولى المركز فتح حساب تلقائي للمستخدم دون احتساب رسوم لجميع المركبات المسجلة باسمه في الإمارة عند تفعيل النظام.
- - للمستخدم إضافة أي مركبات أخرى على نفس الحساب المسجل باسمه بعد إطلاق النظام مقابل دفع الرسم المعتمد من المجلس التنفيذي.
- - على مالك المركبة المسجلة خارج الإمارة وقبل اجتيازه مناطق التعرفة المرورية التسجيل بالنظام وفق الآلية المعتمدة من المركز.
مادة (5)
يستوفي المركز رسماً غير مسترد مقابل تسجيل أو إضافة المركبات في النظام وفق جدول الرسوم المعتمد من المجلس التنفيذي.
مادة (6)
للمستخدم إغلاق حسابه واسترداد الرصيد المتبقي وفق الآلية التي يضعها المركز لذلك.
مادة (7)
على المستخدم القيام بما يلي:
- - توفير رصيد كاف في الحساب عند عبور مناطق التعرفة المرورية. ويجوز للمركبات المسجلة في الإمارة تسديد التعرفة المرورية وفق نظام الدفع اللاحق عند أي إجراء متعلق بترخيص المركبة وذلك في حال عدم توافر رصيد في الحساب.
- - إبقاء لوحات المركبة واضحة لضمان القراءة الصحيحة من قبل النظام.
- - تحديث بياناته الشخصية وبيانات المركبة المسجلة في الحساب عند حدوث أي تغيير عليها خلال خمسة أيام عمل.
مادة (8)
في حال عبور مناطق التعرفة المرورية من قبل مركبة غير مسجلة في النظام يمنح المستخدم مهلة عشرة أيام عمل من وقت عبورها لتسجيلها في النظام وإلا يعتبر مخالفاً.
مادة (9)
في حال عبور مناطق التعرفة المرورية من قبل مركبة مسجلة خارج الإمارة ولم يتوفر في حساب المستخدم رصيد كاف، فيمنح مهلة خمسة أيام عمل لإضافة رصيد وإلا يعتبر مخالفاً.
مادة (10)
- - تحدد أوقات تطبيق التعرفة المرورية وفق الجدول رقم (2) المرفق بهذه اللائحة.
- - يستثنى من تطبيق النظام فئات المركبات المذكورة في الجدول رقم (4) المرفق بهذه اللائحة.
مادة (11)
يتولى المركز التنسيق مع سلطة الترخيص بشأن المخالفات واستيفاء الغرامات وغيرها من المسائل ذات الصلة.
مادة (12)
مع مراعاة أحكام المادتين (8) و (9) من هذه اللائحة، وبصرف النظر عن عدد مرات عبور مناطق التعرفة المرورية في اليوم الواحد دون التسجيل في النظام أو عدم وجود رصيد كاف في الحساب، يترتب على المركبة مخالفة واحدة عن كل يوم، وذلك وفقاً للجدول رقم (3) المرفق بهذه اللائحة.
مادة (13)
يتم عرض التصالح على المخالف ويلتزم الأخير أن يسدد غرامة مالية تعادل 75% من إجمالي الغرامة المحددة للمخالفة في مهلة لا تتجاوز ثلاثين يوماً من تاريخ عرض التصالح عليه، وتنقضي الدعوى الجزائية بالتصالح.
مادة (14)
يجوز للمخالف التظلم على المخالفة خلال مدة التصالح لدى المركز وفق الإجراءات المتبعة لدى المركز.
مادة (15)
- - تشكل لجنة للشكاوى والتظلمات بقرار من مدير عام المركز ويحدد آلية عملها، وتتولى النظر في الشكاوى والتظلمات المتعلقة بالمخالفات.
- - تعقد اللجنة جلساتها بناء على دعوة من رئيسها كلما دعت الحاجة إلى ذلك.
- - تضع اللجنة إجراءات عملها وآلية اتخاذ قراراتها، على أن يتم اعتمادها من الرئيس.
- - تبت لجنة الشكاوى والتظلمات في الموضوع خلال ستين يوماً من تاريخ تبليغ المتظلم بها، ويعتبر عدم البت في التظلم خلال تسعين يوماً من تاريخ تقديمه بمثابة قبول للتظلم.
- - يبلغ المشتكي أو المتظلم بقرار اللجنة خلال مدة لا تتجاوز 5 أيام عمل من تاريخ صدوره.
- - تعتبر قرارات اللجنة قرارات نهائية غير قابلة للاعتراض عليها.
المادة (16)
ينشر هذا القرار في الجريدة الرسمية ويعمل به من تاريخ نشره.

Decision of the Chairman of the Department of Transport No. (22) of 2019
Concerning the Executive Regulations of the Road Toll Law in the Emirate of Abu Dhabi
The Chairman of the Department of Transport:
- - Having reviewed Law No. (1) of 1974 regarding the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (19) of 2006 concerning the Regulation of Taxi Transport in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (17) of 2017 concerning Road Tolls.
- - And Law No. (6) of 2018 concerning the Establishment of the Department of Transport.
- - And the decision of the Chairman of the Executive Council No. (21) of 2018 concerning additional competencies for the Department of Transport.
- - And based on what was presented to the Executive Council and its approval.
Has decided the following:
Article (1)
The provisions of the Executive Regulations of the Road Toll Law in the Emirate of Abu Dhabi, attached to this decision, shall be enacted.
Article (2)
This decision shall be published in the Official Gazette and shall come into effect from the date of its publication.

Executive Regulations of Law No. (17) of 2017 concerning Road Tolls in the Emirate of Abu Dhabi
Article (1)
The following words and phrases shall have the meanings assigned to each of them unless the context indicates otherwise:

| The Executive Council | : The Executive Council of the Emirate |
| The Department | : The Department of Transport |
| The Chairman | : The Chairman of the Department |
| The Center | : The Integrated Transport Centre |
| The Licensing Authority | : The competent authority for licensing vehicles in the Emirate |
| The Vehicle | : Any mechanical means of transport that can be used on the road, whether registered in the Emirate or outside it. |
| The Towed Vehicle | : Any vehicle not driven on the road and is transported by another vehicle licensed to tow vehicles by the licensing authorities in the State. |
| Public Buses | : Public transport buses registered in the Emirate. |
| School Buses | : Every bus authorized by the Department to transport students exclusively. |
| The Electric Vehicle | : Any vehicle licensed by the concerned authorities that operates on electric power only and does not include hybrid vehicles. |
| The Road Toll | : The amount collected from the vehicle owner for passing through one of the road toll application areas. |
| Road Toll Areas | : The areas where special technical devices are installed to collect the road toll. |
| The System | : The electronic road toll system. |
| The User | : The owner of the vehicle registered in the system. |
| One Day | : Starts at 12:00 AM and ends at 11:59 PM of the same day. |
| The Account | : An electronic account created by the Center upon a request submitted by the vehicle owner to register their vehicle in the system. |
Article (2)
The areas for applying the road toll system in the Emirate shall be as specified in Schedule No. (1) attached to these regulations.
The Department may amend or add road toll application areas after the approval of the Executive Council.
Article (3)
The Center shall collect the road toll according to the schedule of fees and tariffs approved by the Executive Council for each vehicle that crosses any of the road toll areas in both directions.
- The road toll shall be collected through the toll gates 24 hours a day, throughout the year, provided that it does not exceed 16 dirhams per vehicle per day.
Article (4)
- - The Center shall establish an electronic road toll system that allows for the opening of accounts and enables users to manage their accounts.
- - The Center shall automatically open an account for the user without charging fees for all vehicles registered in their name in the Emirate upon activation of the system.
- - The user may add any other vehicles to the same account registered in their name after the system launch, upon payment of the fee approved by the Executive Council.
- - The owner of a vehicle registered outside the Emirate must register in the system according to the mechanism approved by the Center before crossing the road toll areas.
Article (5)
The Center shall collect a non-refundable fee for registering or adding vehicles to the system according to the schedule of fees approved by the Executive Council.
Article (6)
The user may close their account and recover the remaining balance according to the mechanism set by the Center for this purpose.
Article (7)
The user must do the following:
- - Ensure sufficient balance in the account when crossing road toll areas. Vehicles registered in the Emirate may pay the road toll through a post-payment system during any procedure related to vehicle licensing in case of insufficient balance in the account.
- - Keep the vehicle's license plates clear to ensure correct reading by the system.
- - Update their personal data and the data of the registered vehicle in the account within five working days of any change.
Article (8)
In the event a vehicle not registered in the system crosses the road toll areas, the user is given a grace period of ten working days from the time of crossing to register it in the system, otherwise, it will be considered a violation.
Article (9)
In the event a vehicle registered outside the Emirate crosses the road toll areas and the user's account has insufficient balance, a grace period of five working days is given to add credit, otherwise, it will be considered a violation.
Article (10)
- - The times for applying the road toll are specified according to Schedule No. (2) attached to these regulations.
- - The vehicle categories mentioned in Schedule No. (4) attached to these regulations are exempted from the application of the system.
Article (11)
The Center shall coordinate with the Licensing Authority regarding violations, collection of fines, and other related matters.
Article (12)
Subject to the provisions of Articles (8) and (9) of these regulations, and regardless of the number of times the road toll areas are crossed in a single day without registration in the system or without sufficient balance in the account, the vehicle shall incur one violation per day, in accordance with Schedule No. (3) attached to these regulations.
Article (13)
A settlement shall be offered to the violator, who must pay a fine equivalent to 75% of the total fine specified for the violation within a period not exceeding thirty days from the date the settlement is offered. The penal action shall be terminated upon settlement.
Article (14)
The violator may appeal the violation during the settlement period to the Center in accordance with the procedures followed by the Center.
Article (15)
- - A Complaints and Grievances Committee shall be formed by a decision of the Director-General of the Center, who shall determine its working mechanism. The committee will handle complaints and grievances related to violations.
- - The committee shall hold its meetings upon the invitation of its chairman whenever necessary.
- - The committee shall establish its working procedures and decision-making mechanism, to be approved by the Chairman.
- - The Complaints and Grievances Committee shall decide on the matter within sixty days from the date the appellant is notified. Failure to decide on the grievance within ninety days from the date of its submission shall be considered as an acceptance of the grievance.
- - The complainant or appellant shall be notified of the committee's decision within a period not exceeding 5 working days from the date of its issuance.
- - The committee's decisions are considered final and not subject to appeal.
Article (16)
This decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
