مرسوم اتحادي رقم ( 54 ) لسنة 2021
بالتصديق على اتفاقية بين حكومة الدولة وحكومة جمهورية بولندا في مجال النقل البحري
نحن خليفة بن زايد آل نهيان رئيس دولة الإمارات العربية المتحدة،
بعد الاطلاع على الدستور،
وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
وبناءً على ما عرضه وزير الطاقة والبنية التحتية، وموافقة مجلس الوزراء، وتصديق المجلس الأعلى للاتحاد،
رسمنا بما هو آت:
المادة الأولى
صودق على اتفاقية بين حكومة الدولة وحكومة جمهورية بولندا في مجال النقل البحري، والتي تم التوقيع عليها في وارسو بتاريخ 20 نوفمبر 2019، والمرفق نصوصها.
المادة الثانية
على وزير الطاقة والبنية التحتية تنفيذ هذا المرسوم من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

في مجال النقل البحري
إن حكومة دولة الإمارات العربية المتحدة
و حكومة جمهورية بولندا
ويشار اليهما فيما بعد بالاطراف المتعاقدة ,
مع عدم الإخلال بالتشريعات القائمة في كل من الأطراف المتعاقدة والتزاماتها تجاه الاتفاقيات الدولية المعمول بها،
وعلى ضوء مصلحة كل من الطرفين ورغبة منهما في توفير أساس قانوني لعلاقات التجارة المتبادلة من خلال النقل البحري بغية ضمان حرية التجارة الخارجية وتعزيز التعاون في هذا المجال إلى أكبر درجة ممكنة؛
وإقراراً منهما بأن التبادل الثنائي للبضائع يجب أن يواكبه تبادل فعال للخدمات مستندين على مبدأ التنافس في تقديم الخدمات؛
وبالإشارة إلى الاتفاقيات الدولية المتعلقة بسلامة الملاحة البحرية، وتسهيل النقل الدولي البحري، ومعيشة وأحوال العمل الخاصة بالبحارة، ونقل البضائع الخطرة، وحماية البيئة البحرية؛
قد اتفقتا على ما يلي :
مادة (1)
تعاريف
لأغراض هذه الاتفاقية، ما لم ينص صراحةً على خلاف ذلك:
1. سلطة النقل البحري المختصة تعني :
أ. بالنسبة لحكومة جمهورية بولندا وزارة تطوير البنى التحتية.
ب. بالنسبة لحكومة دولة الإمارات العربية المتحدة الهيئة الاتحادية للمواصلات البرية والبحرية.
2. "سفينة الطرف المتعاقد " تعني أية سفينة ترفع علم ذلك الطرف، وفقا لأنظمته القانونية ، وجرى تسجيلها وفقا لهذه الأنظمة ، و لغرض هذه الاتفاقية فإن أية سفينة ترفع علم دولة طرف ثالث ومستأجرة لشركة ملاحية مسجلة في أي من طرفي هذه الاتفاقية، تعتبر " سفينة الطرف " خلال فترة الإيجار.
3. "شركة ملاحة بحرية للطرف المتعاقد " : أي كيان قانوني مرخص له القيام بخدمات النقل البحري الدولي والمملوك للشركة و / أو المستأجر للسفن والتي يقع مقرها أو مركز نشاطها في أراضي أي من طرفي هذه الاتفاقية
4. " الطاقم " : يعني أي شخص تكون له خلال الرحلة مهام أو خدمات يؤديها على متن السفينة، واسمه مدرج بسجل الطاقم.
5. "ميناء الطرف المتعاقد" يعني أي ميناء بحري في إقليم الدولة المتعاقده، والمفتوح للملاحه الدوليه .
مادة (2)
الالتزامات الدولية
إن هذه الاتفاقية لا تؤثر على حقوق والتزامات أي من الطرفين المتعاقدين الناجمة عن معاهدات أو اتفاقيات دولية يكون أحدهما طرفا فيها، وكذلك لا تؤثر على الالتزامات الناشئة عن أي اتفاقية أو مذكرة تفاهم أخرى موقعة بين الطرفين ومازالت سارية المفعول.
مادة (3)
حرية الإبحار وعدم التمييز
1. يحق لسفينة تابعة لأي طرف الإبحار إلى أي من الموانئ الواقعة في إقليم أي من الطرفين المتعاقدين والمفتوحة للتجارة الدولية ونقل الركاب والبضائع إلى أقاليم الطرفين وكذلك الى أي منهما وأية دولة أخرى.
2. يمتنع كلا الطرفين عن أي فعل قد يكون ضارا بشركات الملاحة البحرية التابعة لأي منهما في النقل البحري دون الإخلال بالتشريعات السارية لدى كل منهما. وسوف تطبق مبادئ عدم التمييز، والمنافسة الحرة، والاختيار الحر لشركة الملاحة
مادة (4)
تدابير لتسهيل النقل البحري
يعمل الطرفان المتعاقدان على اتخاذ جميع التدابير اللازمة لتسهيل وتعزيز النقل البحري، لتجنب أي تأخير غير ضروري للوقت، وتبسيط وتسريع الجمارك وغيرها من الشكليات التي يجب مراعاتها في الموانئ قدر الامكان.
مادة (5)
المعاملة بالمثل للسفن
1. وفقا لمبدأ المعاملة بالمثل على كل من الطرفين المتعاقدين أن يمنح سفن الطرف الآخر عندما تكون في موانئه ومياهه الإقليمية، وأي مياه خاضعة لسلطته التشريعية، المعاملة نفسها التي يمنحها لسفنه المستخدمة في النقل الدولي البحري.
2. . تطبق أحكام الفقرة 1 من هذه المادة أيضا على وصول السفن للأطراف المتعاقدة في موانئ كل منهما، ومراعاة تحصيل رسوم الموانئ ورسوم علاج الطواقم خلال إقامتهم ومغادرتهم موانئ الاطراف المتعاقده، واستخدام مرافق الموانئ لنقل البضائع، وكذلك الوصول إلى جميع خدمات الموانئ والمرافق الأخرى.
مادة (6)
الأنشطة التجارية
1. فقا لمبدأ المعاملة بالمثل، وذلك حسب النظام المعمول به في كل من الطرفين، يحق لأي من الطرفين بأن تقيم في إقليمه فروعاً خاصة بشركات الملاحة التابعة للطرف الآخر من أجل ممارسة خدمات الوكلاء ومقدمي خدمات الشحن إضافة إلى توظيف الإداريين والكتبة والفنيين لهذه الأغراض.
2. يتم عند إنشاء الفروع وتوظيف العاملين فيها احترام القوانين والأنظمة الأخرى للطرف المضيف والتي تحكم دخول الأجانب وإقامتهم في إقليم هذا الطرف المضيف.
3. وفقا لأحكام الفقرة (2) من هذه المادة، يلتزم الطرفان المتعاقدان بالقوانين المحلية المعمول بها والمتعلقة بدخول وخروج الأجانب.
مادة (7)
حرية تحويل الأموال
يمنح كل من الطرفين المتعاقدين شركات الملاحة البحرية التابعة للطرف الآخر الحق بالنسبة لأية إيرادات يستلمها من خدمات الملاحة البحرية، بما في ذلك إدارة وتسيير عمليات الشحن الابتدائي والنهائي المتعلق بذلك، والمتحققة في إقليم الطرف الآخر، باستخدامها في دفعات ذات صلة بالملاحة البحرية, وبالمقابل يمكن تحويل مثل هذه الإيرادات إلى الخارج بحريّة ودون أية قيود أو تأخير وبسعر الصرف الرسمي بأي عملة قابلة للتحويل.
مادة (8)
الاستثناءات
1. يستثنى من تطبيق أحكام هذه الاتفاقية انواع السفن الآتية:
1.1. السفن الحربية.
1.2. سفن الصيد.
1.3. سفن البحث العلمي.
لا تؤثر هذه المذكرة على قوانين أو أنظمة أي من الطرفين فيما يتعلق بامتيازات العلم الوطني بالنسبة إلى الملاحة الوطنية الساحلية وكذلك أعمال الإنقاذ، والقطر، والإرشاد، وخدمات المساحة البحرية فهي محصورة بسفن الملاحة البحرية التابعة لكل من الطرفين أو للشركات الأخرى ولمواطني ذلك الطرف.
مادة (9)
الالتزام بالنصوص القانونية
1. تخضع السفن التابعة لأي من الطرفين المتعاقدين وطاقمها للقوانين السارية المعمول بها لدى الطرف الآخر أثناء تواجدهم في إقليمه.
2. على الركاب وشاحني البضائع الالتزام بالقوانين والأنظمة السارية المعمول بها في إقليم كل من الطرفين المتعاقدين والتي تحكم دخول وتواجد ومغادرة الركاب
3. وكذلك استيراد، وتخزين، وتصدير البضائع، بما في ذلك النصوص المتعلقة بالإجازات على البر والهجرة والجمارك والضرائب والحجر الصحي.
مادة (10)
الاعتراف المتبادل بوثائق السفن
1. الاعتراف بوثائق أية سفينة تابعة لأي من الطرفين المتعاقدين والتي صدرت أو تم الاعتراف بها وفقاً للاتفاقات الدولية المتعلقة بذلك من قبل الطرف الآخر والتي يجب أن تتواجد على متن السفينة.
2. تـُعفى سفن كل من الطرفين والتي تحمل شهادة الحمولة الدولية لعام (1969 ITC) سارية من الإجراءات الإضافية لقياس الحمولة في موانئ الطرف الآخر. وفي الحالات التي تكون فيها حمولة السفينة معينة أساسا لاحتساب مبلغ أية أجور أو رسوم أو ضرائب فإن الحمولة الواردة في شهادة الحمولة الدولية سيتخذ على أنه هو الأساس وحسب الإجراءات المتبعة في الموانئ لأي من الطرفين.
3. تسدد رسوم ومصاريف الموانئ المستحقة على السفن التي تحمل شهادتين للحمولة وفقا لأحكام الاتفاقية الدولية لقياس حمولة السفن لسنة 1969 ITC، ويتم تحصيل هذه الرسوم على أساس شهادة الحمولة الأكبر.
4. تحتسب الرسوم الخاصة بالسفن التي يقل طولها عن 24 متراً التي لا تخضع للاتفاقية الدولية لقياس حمولة السفن (1969 ITC) بموجب شهادة الحمولة الوطنية الصادرة من أي من الطرفين.
مادة (11)
وثائق سفر أعضاء الطاقم
1. تعتبر وثائق السفر الخاصة بأفراد أطقم السفن سواء كانوا من مواطني أحد الطرفين أو دولة ثالثة والصادرة من السلطات المختصة والتي يجوز استخدامها لاجتياز الحدود بموجب المتطلبات الوطنية المسبقة للطرف الذي سيتم المرور عبر حدوده، وثائق مقبولة لاجتياز حدود الطرف الآخر.
أ) بالنسبة لمواطني جمهورية بولندا- جواز السفر أو كتاب سجل البحار.
ب) بالنسبة لمواطني دولة الإمارات العربية المتحدة - جواز السفر أو كتاب سجل البحار.
2. يعمل الطرفان المتعاقدان من خلال القنوات الدبلوماسية على تبادل وثائق العينة المشار إليها في الفقرة (1) من هذه المادة، في موعد لا يتجاوز الثلاثين يوما التالية ليوم دخول الاتفاقية حيز التنفيذ. ويخطر أي تغيير في هذه الوثيقة في موعد لا يتجاوز ثلاثين يوما لإدخال التعديلات اللازمه .
مادة (12)
الدخول والعبور، والبقاء
1. يجوز لأي من الطرفين، وفقا للقوانين والأنظمة السارية في بلد الطرف المضيف، أن يسمح لأفراد طاقم أية سفينة تابعة للطرف الآخر والذين يحملون وثيقة صالحة لاجتياز الحدود بحسب معنى المادة 11 أعلاه أن ينزلوا إلى البر وأن يتواجدوا في منطقة حدود مدينة الميناء خلال مدة مكوث سفينتهم.
2. تقوم السلطات المختصة لكل من الطرفين، وفقا للقوانين والأنظمة السارية في بلد الطرف المضيف، بإصدار تأشيرة دخول لأفراد طاقم أية سفينة تابعة للطرف الآخر والحاملين لوثيقة صالحة لاجتياز الحدود بحسب معنى المادة ( 11 ) أعلاه وذلك:
(1) لغرض الإعادة إلى الموطن؛
(2) لتمكينهم من الصعود إلى سفنهم أو أية سفينة أخرى؛ أو
(3) لأي سبب آخر يعتبر مقبولا من قبل السلطات المختصة في الطرف الآخر.
3. تسمح السلطات المختصة لدى كل من الطرفين لأي فرد من طاقم أية سفينة تابعة للطرف الآخر يتم إدخاله المستشفى في إقليم الطرف الآخر أن يبقى طيلة المدة اللازمة للعلاج في المستشفى.
4. يحتفظ كل من الطرفين بحق رفض الدخول إلى إقليمه للأشخاص غير المرغوب بهم حتى لو كان مثل هؤلاء الأشخاص حاملين لوثائق السفر المنصوص عنها في المادة (11) أعلاه.
5. تطبيق أحكام هذه المادة لن يؤثر على تشريعات الاطراف المتعاقده فيما يتعلق بالدخول والعبور والبقاء للطاقم .
مادة (13)
الحوادث في عرض البحر
1. إذا تحطمت سفينة تابعة لأي من الطرفين أو جنحت أو تعرضت خلاف ذلك لاستغاثة بينما هي متواجدة في المياه الإقليمية للطرف الآخر ، تقوم سلطات هذا الأخير بتوفر لأفراد طاقم السفينة وركابها والسفينة نفسها ولحمولتها نفس الحماية والمساعدة كما لو كانت السفينة تحمل علمها.
2. في حالة وقوع حادثة بحرية بالمعنى الوارد في الفقرة السابقة، يمتنع أي من الطرفين عن فرض رسوم الاستيراد، بما في ذلك ضريبة الاستهلاك، على أي من حمولة السفينة أو معداتها أو موادها أو تموينها أو توابعها الأخرى فيما عدا استعمال مثل هذه المواد أو استهلاكها في إقليم الطرف المعني. كما يجب إخطار المكتب الفرعي للدائرة الجمركية المختصة بالحادثة البحرية دون أي تأخير. ويتم الاتفاق على الشروط المتعلقة بالتخزين والإعفاء من الرسوم الجمركية الخاصة بالبضائع المعنية.
3. على كلا الطرفين التعاون فيما بينهما عند الطلب، وبموجب الإجراءات المتبعة طبقاً للقوانين السارية لديهما لتأمين سلامة السفن وحماية البيئة البحرية والتي يكون أحد الطرفين على الأقل مسئولا عن هذا التحقيق طبقا للقسم
(6) من مدونة المنظمة البحرية الدولية للتحقيق في الحوادث البحرية. إذا لزم الأمر فإن هذا التعاون يهدف على وجه الخصوص إلى التسهيل في إبرام اتفاقيات على النحو المنصوص عليه في هذه المدونة.
مادة (14)
التعاون الفني
يقوم الطرفان المتعاقدان على تشجيع شركات النقل البحري وأي مؤسسة أخرى تتعلق بالنقل البحري للدول لتطوير كافة المجالات الممكنة للتعاون، ولا سيما في التصنيف البحري، وبناء السفن، وإصلاح وصيانة السفن وإعادة تدوير السفن، والتعليم والتدريب البحري على السفن والإدارة البحرية وإدارة الموانئ، وبناء الموانئ والسلامة والأمن البحري وحماية البيئة البحرية والبحث والانقاذ
مادة (15)
الاستشارات
1. يجوز لكلا الطرفين أو سلطاته البحرية المختصة أن يطلب، في أي وقت، زيارات عمل أو عقد مشاورات مع الطرف الآخر أو مع سلطته البحرية.
2. يجب أن تبدأ أية زيارات عمل أو مشاورات يطلبها أي من الطرفين أو سلطته البحرية خلال فترة لا تتجاوز تسعين (90) يوماً بعد استلام هذا الطلب.
مادة (16)
تسوية النزاعات
في حال نشأ أي نزاع بين الأطراف المتعاقدة فيما يتعلق بتفسير أو تطبيق هذه الاتفاقية، يتعين على الأطراف المتعاقدة أن تسعى إلى تسوية هذا النزاع وديا عن طريق المفاوضات بين السلطات البحرية المختصة في أعقاب طلب للتشاور.
مادة (17)
النفاذ
يدخل هذا الاتفاق حيز التنفيذ بعد ثلاثين يوما من تاريخ استلام آخر إخطار كتابي ، و تقوم الأطراف المتعاقدة بإخطار بعضها البعض على استكمال الإجراءات الداخلية اللازمة لبدء نفاذ هذه الاتفاقية.
مادة (18)
مدة الاتفاقية والتعديلات والإلغاء
يمكن أن يتم تعديل هذه الاتفاقية ويتم تعديلها بموجب موافقة متبادلة بين الأطراف المتعاقدة من خلال من بروتوكول منفصل ويدخل حيز التنفيذ وفقا للمادة 17 من هذه الاتفاقية. وتكون جزءاً لا يتجزأ من هذه الاتفاقية.
المادة (19)
السريان والانسحاب
تبرم هذه الاتفاقية لفترة زمنية غير محددة. يجوز لكل طرف متعاقد إنهاء الاتفاقية في أي وقت عن طريق إعطاء إشعار خطي لإنهاء الطرف المتعاقد الآخر من خلال القنوات الدبلوماسية. في مثل هذه الحالة، فإن . هذه الاتفاقية تنتهي بعد ستة أشهر من تاريخ استلام إشعار الإنهاء من الطرف المتعاقد الآخر
حررت في وارسو بتاريخ 20/نوفمبر/ 2019 من ثلاثة نسخ اصلية، البولندية، و العربية والإنجليزية، وجميع النصوص متساوية في الحجية. في حال الاختلاف في تفسيرها، يعتمد النص الإنجليزي.

AGREEMENT
Between
The Government of the United Arab Emirates
And
The Government of the Republic of Poland
On
Maritime Transport
The Government of the United Arab Emirates and the Government of the Republic of Poland Hereinafter referred to as the "Contracting Parties",
Without prejudice to existing legislation at both Contracting Parties and their obligations towards International Conventions in force, both Parties are desirous to sign the following "Agreement" for cooperation in maritime transport;
in the common interest of both Parties and desirous of providing a legal foundation for the reciprocal trading relations through shipping with a view to ensuring the freedom of foreign trade and enhancing, to the greatest degree possible, co-operation in this field; recognizing that the bilateral exchange of goods should be accompanied by an effective exchange of services based upon the principle of competition in service providing;
referring to the international conventions on the safety of navigation, the facilitation of international maritime transport, the living and working conditions of seafarers, the carriage of dangerous goods, and the protection of the marine environment among other concepts;
Have agreed as follows:
Article 1
Definitions
For the purposes of this Agreement, unless expressly provided otherwise:
1. Competent Maritime Authority" means:
With regard to:
a) The United Arab Emirates, the Federal Transport Authority Land & Maritime (FTA),
b) The Republic of Poland, the Minister of Maritime Economy and Inland Navigation.
2. "Vessel of the Contracting Party" means a vessel, which, in accordance with the regulations of such Contracting Party, flying its flag and has been entered in a register. and any vessel flying the flag of a third state and chartered/operated by a shipping company of one of the Contracting Parties, shall also deemed to be a "vessel of a Contracting Party" within the period of this charter.
3. "Shipping Company of the Contracting Party" means any legal entity which is licensed/authorized to carry out international shipping service with its owned and/or chartered vessels and has its headquarters or principle place of business in the territory of the State of either of the Contracting Parties.
4. "member of the crew" means any person who, during the voyage, has duties to perform services on board the vessel and whose name is inscribed on the crew list;
5. "Port of the Contracting Party" means any sea-port in the territory of the State of the Contracting Party, which is open to international shipping.
"Article 2
International Obligations
The present Agreement shall not affect the rights and obligations of the Contracting Parties arising from international conventions or bilateral agreement at regional or international level to which either of them is a Party, and also does not affect the obligations arising out of any other valid agreements or memorandums signed between the Cotrcating Parties.
Article 3
Freedom of Shipping; non-discrimination
(1) A vessel of the Contracting Party shall be entitled to sail to any of the ports in the territory of the state of either Contracting Party that are open to international trade and to carry passengers and cargo to the territories of the State of the Contracting Parties as well as to either of these and third state.
(2) The Contracting Parties without prejudice to existing legislation at both the Contracting Parties shall refrain from any action that might be detrimental to the unrestricted participation of the shipping companies of the Contracting Parties in
maritime transport the principles of non-discrimination, of free competition, and of the free choice of shipping company shall apply.
Article 4
Measures to facilitate maritime transport
The Contracting Parties shall take all measures necessary to facilitate and promote maritime transport, to avoid any unnecessary prolongation of lay times, and to simplify and expedite, wherever possible, customs and other formalities to be observed in ports.
Article 5
Equal treatment of vessels
1. On the basis of reciprocity, either Contracting Party shall grant the vessels of the other Contracting Party, when in its ports, territorial waters, or other waters under its jurisdiction, the same treatment granted to vessels of the most – favoured-nation treatment,
2. The provision of paragraph 1 of this Article shall also apply to access of vessels of the Contracting Parties to ports of the Contracting Parties, to collection of port fees and charges, to treatment during staying and departure ports, to the use of port facilities for transportation of cargo, as well as access to all other port services and facilities.
Article 6
Commercial activities
1. On the basis of reciprocity, either Contracting Party according to the rules applicable to the other Contracting Party, shall grant the shipping companies of the other Contracting Party the right to set up and maintain in the territory of its state, branches and representatives offices of their own for the exercise and use of agents' and forwarders' services as well as to enrol administrative, clerical, and technical personnel for these purposes.
2. The laws and other regulations of the host Contracting Party governing the entry of foreigners and their stay in the territory of the host Contracting Party, shall be complied with in the process of setting up the branches and representatives offices and the employment of the personnel.
3. Under the provisions of paragraph (2) of this Article, the domestic laws in force in the Contracting Parties relating to the entry and repatriation of foreigners shall remain applicable.
Article 7
Free transfer of funds
Either Contracting Party shall grant the shipping companies of the other Contracting Party the right to use any revenues from shipping services, including the management and conduct of initial or terminal haulage connected therewith, towards shipping-related payments. Alternatively, such revenues may also be transferred abroad, freely and without any restriction or delay, in any convertible currency at the official rate of exchange.
Article 8
Exemptions
1. The provisions of the present Agreement shall not apply to the following types of vessels:
1. Warships;
2. fishing vessels;
3. research vessels;
4. Vessels used by the government for non-commercial purposes.
2. The present Agreement shall not affect the laws and regulations of either Contracting Party concerning the privilege of the national flag with regard to national coastal navigation as well as to salvage, towage, pilotage, and hydrographic services, which are reserved for either Contracting Party's national shipping or other companies and for its own citizens.
Article 9
Compliance with legal provisions
(1) A vessel of either Contracting Party or her crew members, during their stay in the territory of the State of the other Contracting Party, shall be subject to the laws in force there.
(2) Passengers and consignors of goods shall comply with the laws and regulations in force in the territory of both Contracting Parties and governing the entry, stay and departure of passengers
(3) As well as the import, storage, and export of goods, including the provisions concerning shore leave, immigration, customs, taxation, and quarantine.
Article 10
Reciprocal recognition of vessels documents
(1) Documents for a vessel of either Contracting Party, which have been issued or recognized in accordance with relevant international conventions, shall be carried on board and recognized by the other Party.
(2) Vessels of either Contracting Party carrying a valid International Tonnage Certificate (1969) shall be exempt from further tonnage measurement in the ports of the other Contracting Party. In cases where the tonnage of the vessel is to be the basis for calculating the amount of any charges, fees, and taxes, the tonnage notation given in the International Tonnage Certificate shall be taken as such basis.
(3) Fees and expenses owed to the ports by vessels carrying two tonnage certificates with the provisions of the International Convention on Tonnage Measurement of Vessels,1969, port charges shall be based on the certificate of the highest tonnage.
(4) Vesselsof less than 24 meters in length, which are not subject to the International Convention on Tonnage Measurement of Vessels (1969) calculated their own fees under the national tonnage certificate issued by any of the Contracting Parties shall be considered.
Article 11
Travel documents of the members of the crew
(1) For the members of the crew, whether they are citizens of one of the Contracting Parties or of a third state, those travel documents issued by the competent authorities that may be used for border crossing under the national prerequisites of the
Contracting Party the border of which is to be crossed shall be deemed admissible border-crossing documents.
A) For the nationals of the Republic of Poland- Passport or the Seaman's book
B) For the nationals of the United Arab Emirates – Passport or the Seaman's book.
(2) The Contracting Parties shall exchange through diplomatic channels the specimen documents referred to in paragraph (1) of this Article, not later than thirty days following the day the present Agreement entry into force. Any change of such document shall be notified not later than thirty days prior to introduction of change thereof.
Article 12
Entry, transit, and stay
1. Each of the Contracting Parties shall allow the crew members of the vessel of the other Contracting Party who are holders of one of the documents listed in Article 11 of this Agreement and of the visa or another relevant document, if required, to go
2. Every crew member holding any of the documents listed in Article 11 of this Agreement and of the visa, if required, may pass in transit the territory of the State of the other Contracting Party for the following purposes:
1) Return to the territory of the home country;
2) Joining vessel;
3) For any other purpose recognized as justified by the Competent Authorities of the other Contracting Party.
3. The Competent Authorities of the Contracting Parties shall issue the stay permit to any crew member admitted to hospital in the territories of their States, for the period of time necessary for treatment.
4. Without prejudice to paragraph (3), the Contracting Parties reserve the right to refuse entry into the territories of their States of undesirable persons, also in those cases when such persons hold any of the documents listed in Article 11 of this Agreement and the visa, if required.
5. The provisions of this Article shall not affect the legislation of the States of the Contracting Parties in respect of entry, transit, stay and departure of foreigners.
Article 13
Incidents at sea
1. Should a vessel of one of the Contracting Party suffer from an accident or encounter any other danger in the area of internal waters or in the territorial sea of the State of the other Contracting Party, the Competent Authorities of the other Contracting Party shall take all the measure necessary to render help and assistance to crew members, passengers, the vessel and cargo, to the same extent as in the case of a vessel flying that Contracting Party's flag. Whilst determining the causes of maritime accidents, the Contracting Parties
shall comply with the principles set out in the provisions of the International Maritime Organisation (IMO) Casualty Investigation Code.
2. The Competent Authorities of the Contracting Party, in whose internal waters or territorial sea a vessel of the other Contracting Party has suffered from an accident or encountered any other danger referred to in paragraph 1 of this Article, shall notify, as soon as possible, the event to the nearest consular office of the State of the other Contracting Party.
3. The provisions of this Article shall not limit the rights to claims in respect to sea rescue and salvage services, assistance and help granted to a vessel, its passengers, crew and cargo.
Article 14
Technical Co-operation
The Contracting Parties shall encourage maritime transport companies and any other institution related to maritime transport of their States to develop all possible fields of co-operation, in particular in the ships' classification, shipbuilding, ship repair and ship maintenance and ship recycling, maritime education, maritime administration, port management, port construction, maritime safety and security, marine environment protection and search and rescue.
Article 15
Consultations
(1) Either Contracting Party or its competent maritime authorities may request, at any time, working visits or consultations with the other Contracting Party or its maritime authority.
(2) Any such working visits or consultations requested by either Contracting Party or its maritime authority should begin within a period not exceeding ninety (90) days following the receipt of such request.
Article 16
Settlement of Disputes
Should any dispute arise between the Contracting Parties with regard to the interpretation or application of the present Agreement, the Contracting Parties shall seek to settle such dispute amicably through negotiations between their competent maritime authorities following a request for consultations.
Article 17
Entry into force of the Agreement
This Agreement shall enter into force thirty days after the date of the receipt of the last written notification, by which the Contracting Parties shall notify each other on the completion of internal procedures necessary for the entry into force of this Agreement.
Article 18
The provisions of this Agreement may be modified and amended by a mutual consent of the Contracting Parties, which shall be formed as a separate protocol and enter into force
in accordance with Article 17 of this Agreement. Protocols formed thereby shall constitute an integral part of this Agreement.
Article 19
Duration and Denunciation
This Agreement shall be concluded for an indefinite period of time. Each Contracting Party may terminate the Agreement at any time by giving a written notice of termination to the other Party through diplomatic channels. In such a case, this Agreement shall expire six months after the day of the receipt of the termination notice by the other Contracting Party.
Done at Warsaw on 20. November. 2019 in two originals copies, each in the Polish, Arab and English languages, all texts being equally authentic. In case of divergence in their interpretation, the English text shall prevail.

A
RZĄDEM PAŃSTWA ZJEDNOCZONYCH EMIRATÓW ARABSKICH
O TRANSPORCIE MORSKIM
Rząd Rzeczypospolitej Polskiej i Rząd Państwa Zjednoczonych Emiratów Arabskich, zwane dalej „Umawiającymi się Stronami",
nie naruszając postanowień istniejącego prawodawstwa obu Umawiających się Stron i zobowiązań na podstawie wiążących je umów międzynarodowych, pragną podpisać niniejszą Umowę o transporcie morskim,
mając na względzie wzajemne korzyści obu Umawiających się Stron oraz ustanowienie podstaw prawnych dla rozwoju wzajemnej współpracy handlowej w dziedzinie transportu morskiego, celem zapewnienia wolności w handlu zagranicznym i wzmocnienia, w najwyższym możliwym stopniu, współpracy w tej dziedzinie; uznając, że dwustronnej wymianie dóbr powinna towarzyszyć efektywna wymiana usług oparta na zasadach uczciwej konkurencji,
uwzględniając między innymi postanowienia umów międzynarodowych dotyczących bezpieczeństwa morskiego, ułatwień w międzynarodowym transporcie morskim, socjalnych warunków życia i pracy marynarzy na morzu, przewozu ładunków niebezpiecznych, ochrony środowiska morskiego,
uzgodniły, co następuje:
Artykuł 1
Definicje
Dla celów niniejszej Umowy, jeśli nie postanowiono inaczej, użyte określenia oznaczają:
1) „właściwe organy Umawiających się Stron":
a) w Rzeczypospolitej Polskiej – Ministra Gospodarki Morskiej i Żeglugi Śródlądowej,
b) w Państwie Zjednoczonych Emiratów Arabskich – Federalna Dyrekcja Transportowa i Morska (FTA);
2) „statek Umawiającej się Strony" – każdy statek morski wpisany do rejestru okrętowego zgodnie z przepisami prawa obowiązującymi na terytorium Państwa Umawiającej się Strony podnoszący banderę tego Państwa oraz każdy statek podnoszący obcą banderę czarterowany / eksploatowany przez przedsiębiorstwa żeglugi morskiej Umawiających się Stron i podczas tego czarteru / eksploatacji uznawany za statek podnoszący banderę Państwa jednej z Umawiających się Stron;
3) „przedsiębiorstwo żeglugi morskiej Umawiającej się Strony" – podmiot prawny zarejestrowany na terytorium Państwa jednej z Umawiających się Stron zgodnie z obowiązującymi przepisami prawa tego Państwa, upoważniony do prowadzenia międzynarodowej żeglugi własnym i/lub czarterowanym statkiem, posiadający siedzibę lub miejsce zamieszkania na terytorium Państwa tej Umawiającej się Strony;
4) „członek załogi" - każdą osobę, która jest zatrudniona na statku podczas podróży i jest wpisana na listę załogi;
5) „port Umawiającej się Strony" – każdy port morski znajdujący się na terytorium Państwa Umawiającej się Strony, otwarty dla żeglugi międzynarodowej.
Artykuł 2
Zobowiązania międzynarodowe
Umowa niniejsza nie narusza praw i zobowiązań Umawiających się Stron wynikających z wiążących je międzynarodowych konwencji lub umów dwustronnych tak na poziomie regionalnym jak i międzynarodowym, a także nie narusza zobowiązań wynikających z innych obowiązujących wzajemnie umów lub porozumień podpisanych przez obie Umawiające się Strony.
Artykuł 3
Wolność żeglugi i niedyskryminacja
1. Statek Umawiającej się Strony ma prawo zawijania do każdego z portów drugiej Umawiającej się Strony otwartych do międzynarodowego handlu, a także do przewozu pasażerów i ładunków między terytorium Państw obu Umawiających się Stron, jak również między każdym z nich a państwami trzecimi.
2. Umawiające się Strony, nie naruszając ich przepisów prawnych, powstrzymają się od wszelkich działań, które mogłyby zaszkodzić nieograniczonemu udziałowi przedsiębiorstw żeglugi morskiej Umawiających się Stron w transporcie morskim w oparciu o zasady niedyskryminacji, uczciwej konkurencji i wolnego wyboru przedsiębiorstw żeglugi morskiej.
Artykuł 4
Ułatwienia w transporcie morskim
Umawiające się Strony podejmą wszelkie niezbędne działania w celu ułatwienia i promowania rozwoju transportu morskiego dla uniknięcia niepotrzebnego przedłużania postoju statków w portach, a także na ile to możliwe, uproszczenia i przyspieszenia formalności celnych oraz wszelkich innych formalności stosowanych w ich portach.
Artykuł 5
Równe traktowanie statków
1. Każda z Umawiających się Stron, na zasadzie wzajemności, zapewni statkom drugiej Umawiającej się Strony w swoich portach, na morzu terytorialnym lub na innych wodach pozostających w obszarze ich jurysdykcji, takie samo traktowanie, jakie jest przewidziane dla statków państwa najbardziej uprzywilejowanego.
2. Postanowienia ustępu 1 niniejszego Artykułu dotyczą również dostępu do portów Umawiających się Stron, pobierania podatków i opłat portowych, traktowania podczas pobytu w portach i wyjścia z portów, korzystania z urządzeń portowych do transportu towarów, jak również dostępu do wszystkich innych usług i urządzeń portowych.
Artykuł 6
Działalność handlowa
1. Na zasadzie wzajemności, każda z Umawiających się Stron, zgodnie z przepisami prawa, mającymi zastosowanie do drugiej Umawiającej się Strony, przyzna przedsiębiorstwom żeglugi morskiej drugiej Umawiającej się Strony prawo do tworzenia własnych przedstawicielstw i oddziałów na terytorium swojego Państwa w celu wykonywania usług agencji żeglugowych i spedycji towarów, jak również zapewnienia zaplecza administracyjnego i technicznego w tym celu.
2. Tworzenie przedstawicielstw i oddziałów oraz zatrudnianie w tym celu personelu pozostaje w zgodzie z obowiązującymi przepisami prawa goszczącej Umawiającej się Strony dotyczącymi wjazdu i pobytu cudzoziemców na terytorium goszczącej Umawiającej się Strony.
3. Zgodnie z postanowieniami ustępu 2 niniejszego Artykułu, obowiązujące prawo krajowe Umawiających się Stron odnoszące się do wjazdu i wyjazdu cudzoziemców stosuje się odpowiednio.
Artykuł 7
Transfer przychodów przedsiębiorstw żeglugi morskiej
Każda z Umawiających się Stron przyznaje przedsiębiorstwom żeglugi morskiej drugiej Umawiającej się Strony prawo do wykorzystywania przychodów za usługi transportu morskiego, włączając w to załadunek i wyładunek statku oraz zarządzanie z nimi związane, na płatności dotyczące transportu morskiego. Takie przychody mogą zostać również transferowane za granicę bez stosowania jakichkolwiek ograniczeń lub opóźnień, w dowolnej oficjalnie wymienialnej walucie, po kursie oficjalnym.
Artykuł 8
Dziedziny wyłączone z zakresu Umowy
1. Postanowienia niniejszej Umowy nie obejmują następujących typów statków:
1) okrętów marynarki wojennej;
2) statków rybackich;
3) statków badawczych;
4) statków pełniących służbę państwową wykorzystywanych w niekomercyjnych celach.
2. Niniejsza Umowa nie narusza przepisów prawa Umawiających się Stron dotyczących uprawnień własnej bandery w zakresie kabotażu, ratownictwa, holowania, pilotażu i innych usług hydrograficznych związanych z transportem morskim zastrzeżonych dla przedsiębiorstw żeglugi morskiej każdej z Umawiających się Stron lub innych przedsiębiorstw, jak również dla obywateli Państwa tej Umawiającej się Strony.
Artykuł 9
Przestrzeganie obowiązujących przepisów prawa
1. Statki jednej Umawiającej się Strony, jak również ich załogi, znajdujące się podczas ich pobytu na terytorium Państwa drugiej Umawiającej się Strony, podlegają odpowiednim przepisom prawa obowiązującym na terytorium tego Państwa.
2. Pasażerowie i spedytorzy towarów podlegają przepisom prawa i zasadom obowiązującym na terytorium obu Umawiających się Stron dotyczących wjazdu, pobytu i wyjazdu cudzoziemców.
3. Powyższe zasady stosuje się odpowiednio do importu, przechowywania i eksportu towarów, które podlegają przepisom dotyczącym pobytu czasowego członków załóg, imigracji, ceł, podatków oraz przepisów sanitarnych.
Artykuł 10
Wzajemne uznawanie dokumentów statków
1. Dokumenty statku każdej z Umawiających się Stron, wydane lub uznane zgodnie z odpowiednimi przepisami umów międzynarodowych, znajdujące się na jego pokładzie, będą uznawane przez drugą Umawiającą się Stronę.
2. Statki każdej z Umawiających się Stron posiadające ważne świadectwa pomiarowe wydane zgodnie z Międzynarodową Konwencją o pomierzaniu pojemności statków z 1969 r. będą zwolnione z ponownego pomiaru w portach drugiej Umawiającej się Strony. W przypadku gdy tonaż statku stanowi podstawę do stosowania obliczeń wysokości jakichkolwiek opłat, podatków i należności, za podstawę do ich naliczania przyjmuje się pojemność tonażową wskazaną w świadectwie pomiarowym.
3. Statki posiadające dwa świadectwa pomiarowe zgodne z postanowieniami Międzynarodowej Konwencji o pomierzaniu pojemności statków z 1969 r. będą uiszczały
opłaty i należności portowe na podstawie świadectwa pomiarowego wskazującego tonaż wyższy.
4. Statkom poniżej 24 metrów długości, do których nie stosuje się postanowień Międzynarodowej Konwencji o pomierzaniu pojemności statków z 1969 r., uznaje się obliczenia opłat i należności portowych na podstawie krajowych świadectw tonażowych wydanych przez jedną z Umawiających się Stron.
Artykuł 11
Dokumenty tożsamości członków załogi
1. Każda z Umawiających się Stron uznaje oficjalne dokumenty tożsamości członków załóg, będących obywatelami Państw Umawiających się Stron lub państwa trzeciego, wydane przez właściwe organy, uprawniające do przekraczania granicy państwa zgodnie z wymaganiami krajowych przepisów prawnych tej Umawiającej się Strony, której granica ma być przekroczona. Są to następujące dokumenty:
a) dla obywateli Rzeczypospolitej Polskiej – paszport lub Książeczka żeglarska,
b) dla obywateli Państwa Zjednoczonych Emiratów Arabskich – paszport lub Książeczka żeglarska.
2. Umawiające się Strony wymienią w drodze dyplomatycznej wzory dokumentów, o których mowa w ustępie 1 niniejszego Artykułu, nie później niż w terminie trzydziestu dni po dniu wejścia w życie niniejszej Umowy. Jakiekolwiek zmiany w tych dokumentach będą notyfikowane nie później niż w terminie trzydziestu dni przed ich zmianą lub wprowadzeniem.
Artykuł 12
Wjazd, tranzyt i pobyt
1. Każda z Umawiających się Stron zezwala członkom załogi statku drugiej Umawiającej się Strony, posiadającym jeden z dokumentów wymienionych w Artykule 11 niniejszej Umowy oraz wizę lub inny odpowiedni dokument, jeżeli są one wymagane, na zejście na ląd i pobyt w obrębie miasta portowego przez czas pobytu statku w porcie Umawiającej się Strony, zgodnie z odpowiednimi przepisami prawa obowiązującymi w tym Państwie.
2. Każdy członek załogi, będący posiadaczem jednego z wymienionych w Artykule 11 niniejszej Umowy dokumentów oraz wizy, jeżeli jest wymagana, może przejechać tranzytem przez terytorium Państwa drugiej Umawiającej się Strony w następujących celach:
1) powrotu na terytorium własnego Państwa;
2) udania się na statek;
3) w każdym innym celu uznanym przez właściwe organy drugiej Umawiającej się Strony za uzasadniony.
3. Właściwe organy Umawiających się Stron wydadzą zezwolenie na pobyt każdemu członkowi załogi, który został przyjęty do szpitala na terytorium ich Państwa, na okres czasu wymagany leczeniem szpitalnym.
4. Nie naruszając postanowień ustępu 3, Umawiające się Strony zastrzegają sobie prawo odmowy wjazdu na terytoria ich Państw osób niepożądanych także w tych przypadkach, gdy osoby te są posiadaczami jednego z dokumentów wymienionych w Artykule 11 niniejszej Umowy oraz wizy, jeżeli jest wymagana.
5. Postanowienia niniejszego Artykułu nie naruszają przepisów prawa obowiązującego na terytorium Państw Umawiających się Stron dotyczących wjazdu, tranzytu, pobytu i wyjazdu cudzoziemców.
Artykuł 13
Wypadki morskie
1. Jeżeli statek jednej Umawiającej się Strony ulegnie wypadkowi lub znajdzie się w innej niebezpiecznej sytuacji na obszarze morskich wód wewnętrznych lub na morzu terytorialnym Państwa drugiej Umawiającej się Strony, to właściwe organy drugiej Umawiającej się Strony podejmą wszelkie niezbędne działania do udzielenia pomocy i opieki członkom załogi, pasażerom, statkowi i ładunkowi w tym samym zakresie, w jakim byłyby udzielone statkowi podnoszącemu banderę Państwa tej Umawiającej się Strony. Podczas ustalania przyczyn wypadków morskich Umawiające się Strony będą stosować się do zasad określonych w przepisach Kodeksu Badania Wypadków Morskich Międzynarodowej Organizacji Morskiej (IMO).
2. Właściwe organy jednej Umawiającej się Strony, na której morskich wodach wewnętrznych lub morzu terytorialnym statek drugiej Umawiającej się Strony doznał wypadku lub znalazł się w niebezpiecznej sytuacji, zgodnie z ustępem 1 niniejszego Artykułu, powiadomią niezwłocznie o tym zdarzeniu najbliższy urząd konsularny Państwa drugiej Umawiającej się Strony.
3. Postanowienia niniejszego Artykułu nie naruszają praw do roszczeń z tytułu poszukiwania i ratownictwa morskiego, opieki i pomocy udzielonej statkowi, jego pasażerom, załodze i ładunkowi.
Artykuł 14
Współpraca techniczna
Umawiające się Strony będą zachęcać przedsiębiorstwa żeglugi morskiej oraz inne instytucje związane z transportem morskim swoich Państw, aby rozwijały wszelkie możliwe formy współpracy, w szczególności w dziedzinach klasyfikacji statków, budowy statków, naprawy, utrzymania i złomowania statków, edukacji morskiej, administracji morskiej, zarządzania i rozbudowy portów, bezpieczeństwa i ochrony żeglugi morskiej, ochrony środowiska morskiego oraz poszukiwania i ratownictwa morskiego.
Artykuł 15
Konsultacje
1. Każda z Umawiających się Stron lub jej właściwe organy administracji morskiej w każdym czasie mogą żądać wizyt roboczych lub konsultacji z drugą Umawiającą się Stroną lub jej właściwymi organami administracji morskiej.
2. Takie wizyty robocze lub konsultacje powinny odbywać się na wniosek każdej z Umawiających się Stron lub jej właściwych organów administracji morskiej w terminie nieprzekraczającym dziewięćdziesięciu dni po dniu otrzymania powyższego wniosku.
Artykuł 16
Rozstrzyganie sporów
Wszelkie spory wynikające ze stosowania lub interpretacji niniejszej Umowy będą rozwiązywane w sposób polubowny w drodze negocjacji przez właściwe organy administracji morskiej Umawiających się Stron, po uwzględnieniu wniosku w sprawie konsultacji.
Artykuł 17
Wejście w życie Umowy
Umowa niniejsza wejdzie w życie po upływie trzydziestu dni po dniu otrzymania w drodze dyplomatycznej pisemnej noty późniejszej, w której Umawiające się Strony poinformują się wzajemnie, że warunki wymagane przez wewnętrzne ustawodawstwa ich Państw dla wejścia w życie niniejszej Umowy zostały wypełnione.
Artykuł 18
Zmiany
Postanowienia niniejszej Umowy mogą być zmieniane w drodze wzajemnego porozumienia Umawiających się Stron, w formie oddzielnych protokołów, które wejdą w życie w trybie ustanowionym w Artykule 17 niniejszej Umowy. Takie protokoły stanowić będą integralną część niniejszej Umowy.
Artykuł 19
Czas trwania i wypowiedzenie
Umowa niniejsza zawarta jest na czas nieokreślony. Każda z Umawiających się Stron może w dowolnym czasie wypowiedzieć niniejszą Umowę, przekazując w drodze dyplomatycznej pisemną notę drugiej Umawiającej się Stronie. W takim przypadku niniejsza Umowa utraci moc po upływie sześciu miesięcy po dniu otrzymania tej noty przez drugą Umawiającą się Stronę.
Umowę niniejszą sporządzono w Warszawie dnia 20 listopada 2019 roku, w dwóch jednobrzmiących egzemplarzach, każdy w językach polskim, arabskim i angielskim, przy czym wszystkie teksty są jednakowo autentyczne. W razie rozbieżności przy ich interpretacji tekst w języku angielskim uważany będzie za rozstrzygający.

Ratifying the Agreement between the Government of the State and the Government of the Republic of Poland in the field of Maritime Transport
We, Khalifa bin Zayed Al Nahyan, President of the United Arab Emirates,
Having reviewed the Constitution,
And Federal Law No. (1) of 1972 concerning the competencies of Ministries and the powers of Ministers, and its amendments,
And based on the proposal of the Minister of Energy and Infrastructure, the approval of the Cabinet, and the ratification of the Federal Supreme Council,
Have decreed the following:
Article One
The Agreement between the Government of the State and the Government of the Republic of Poland in the field of Maritime Transport, signed in Warsaw on November 20, 2019, is hereby ratified, and its text is attached.
Article Two
The Minister of Energy and Infrastructure shall implement this Decree from the date of its issuance, and it shall be published in the Official Gazette.

Hereinafter referred to as the "Contracting Parties",
Without prejudice to existing legislation at both Contracting Parties and their obligations towards International Conventions in force,
in the common interest of both Parties and desirous of providing a legal foundation for the reciprocal trading relations through shipping with a view to ensuring the freedom of foreign trade and enhancing, to the greatest degree possible, co-operation in this field;
recognizing that the bilateral exchange of goods should be accompanied by an effective exchange of services based upon the principle of competition in service providing;
referring to the international conventions on the safety of navigation, the facilitation of international maritime transport, the living and working conditions of seafarers, the carriage of dangerous goods, and the protection of the marine environment;
Have agreed as follows:
Article (1)
Definitions
For the purposes of this Agreement, unless expressly provided otherwise:
1. Competent Maritime Authority means:
a. For the Government of the Republic of Poland, the Ministry of Infrastructure Development.
b. For the Government of the United Arab Emirates, the Federal Transport Authority - Land & Maritime.
2. "Vessel of the Contracting Party" means any vessel flying the flag of that Party, in accordance with its legal regulations, and registered in accordance with these regulations. For the purpose of this agreement, any vessel flying the flag of a third country and chartered to a shipping company registered in either of the parties to this agreement shall be considered a "vessel of the Party" during the charter period.
3. "Shipping Company of the Contracting Party": Any legal entity licensed to perform international maritime transport services and owned by the company and/or charterer of vessels whose headquarters or center of activity is located in the territory of either party to this agreement.
4. "Crew": Means any person who has duties or services to perform on board the vessel during the voyage, and whose name is listed in the crew register.
5. "Port of the Contracting Party" means any sea-port in the territory of the Contracting State, which is open to international navigation.
Article (2)
International Obligations
This Agreement shall not affect the rights and obligations of either of the Contracting Parties arising from international treaties or agreements to which either is a party, nor shall it affect the obligations arising from any other agreement or memorandum of understanding signed between the Parties and still in force.
Article (3)
Freedom of Navigation and Non-Discrimination
1. A vessel belonging to either Party shall have the right to sail to any of the ports located in the territory of either of the Contracting Parties that are open to international trade and to transport passengers and goods to the territories of both Parties, as well as to either of them and any other country.
2. Both Parties shall refrain from any act that may be detrimental to the shipping companies of either Party in maritime transport, without prejudice to the legislation in force in each of them. The principles of non-discrimination, free competition, and free choice of shipping company shall apply.
Article (4)
Measures to Facilitate Maritime Transport
The Contracting Parties shall take all necessary measures to facilitate and promote maritime transport, to avoid any unnecessary delay of time, and to simplify and expedite customs and other formalities to be observed in ports as much as possible.
Article (5)
Reciprocal Treatment of Vessels
1. In accordance with the principle of reciprocity, each of the Contracting Parties shall grant the vessels of the other Party, when in its ports, territorial waters, and any waters subject to its legislative authority, the same treatment that it grants to its own vessels used in international maritime transport.
2. The provisions of paragraph 1 of this Article shall also apply to the access of vessels of the Contracting Parties to the ports of each other, the collection of port fees and charges for the treatment of crews during their stay in and departure from the ports of the Contracting Parties, the use of port facilities for the transport of goods, as well as access to all port services and other facilities.
Article (6)
Commercial Activities
1. In accordance with the principle of reciprocity, and according to the system in force in each of the Parties, either Party has the right to establish branches in its territory for the shipping companies of the other Party in order to provide services as agents and freight forwarders, in addition to employing administrators, clerks, and technicians for these purposes.
2. The establishment of branches and the employment of their staff shall respect the laws and other regulations of the host Party governing the entry and residence of foreigners in the territory of that host Party.
3. In accordance with the provisions of paragraph (2) of this Article, the Contracting Parties shall abide by the applicable local laws concerning the entry and exit of foreigners.
Article (7)
Freedom of Transfer of Funds
Each of the Contracting Parties shall grant the shipping companies of the other Party the right, with respect to any revenue received from maritime navigation services, including the management and operation of primary and final shipping related thereto, realized in the territory of the other Party, to use it for payments related to maritime navigation. In return, such revenues may be transferred abroad freely and without any restrictions or delay, at the official exchange rate in any convertible currency.
Article (8)
Exemptions
1. The provisions of this Agreement shall not apply to the following types of vessels:
1.1. Warships.
1.2. Fishing vessels.
1.3. Scientific research vessels.
This memorandum does not affect the laws or regulations of either Party concerning the privileges of the national flag with respect to national coastal navigation, as well as salvage, towing, piloting, and hydrographic survey services, which are reserved for the maritime navigation vessels of each Party or for other companies and citizens of that Party.
Article (9)
Compliance with Legal Provisions
1. Vessels of either Contracting Party and their crew shall be subject to the applicable laws in force of the other Party while in its territory.
2. Passengers and shippers of goods shall comply with the laws and regulations in force in the territory of each of the Contracting Parties governing the entry, presence, and departure of passengers.
3. As well as the import, storage, and export of goods, including provisions related to shore leave, immigration, customs, taxes, and quarantine.
Article (10)
Mutual Recognition of Vessel Documents
1. Recognition of the documents of any vessel belonging to either of the Contracting Parties which were issued or recognized in accordance with the relevant international agreements by the other Party and which must be on board the vessel.
2. Vessels of each of the Parties holding a valid International Tonnage Certificate (1969 ITC) shall be exempt from additional tonnage measurement procedures in the ports of the other Party. In cases where the tonnage of the vessel is the basis for calculating the amount of any wages, fees, or taxes, the tonnage stated in the International Tonnage Certificate shall be taken as the basis, according to the procedures followed in the ports of either Party.
3. Fees and port charges due on vessels carrying two tonnage certificates shall be paid in accordance with the provisions of the International Convention on Tonnage Measurement of Ships, 1969 (ITC), and these fees shall be collected on the basis of the larger tonnage certificate.
4. Fees for vessels less than 24 meters in length, which are not subject to the International Convention on Tonnage Measurement of Ships (1969 ITC), shall be calculated on the basis of the national tonnage certificate issued by either Party.
Article (11)
Travel Documents for Crew Members
1. The travel documents of crew members, whether they are citizens of one of the Parties or a third country, issued by the competent authorities and which may be used to cross borders under the national requirements of the Party whose border is to be crossed, shall be considered acceptable documents for crossing the border of the other Party.
a) For citizens of the Republic of Poland - Passport or Seaman's Book.
b) For citizens of the United Arab Emirates - Passport or Seaman's Book.
2. The Contracting Parties shall, through diplomatic channels, exchange specimen documents referred to in paragraph (1) of this Article, no later than thirty days following the day this Agreement enters into force. Any change in this document shall be notified no later than thirty days for the necessary amendments to be made.
Article (12)
Entry, Transit, and Stay
1. Either Party may, in accordance with the laws and regulations in force in the host country, permit crew members of any vessel of the other Party who hold a valid document for crossing the border within the meaning of Article 11 above to go ashore and be present in the border area of the port city for the duration of their vessel's stay.
2. The competent authorities of each of the Parties shall, in accordance with the laws and regulations in force in the host country, issue an entry visa to crew members of any vessel of the other Party holding a valid document for crossing the border within the meaning of Article (11) above, for the purpose of:
(1) Repatriation;
(2) Enabling them to board their vessel or any other vessel; or
(3) For any other reason considered acceptable by the competent authorities of the other Party.
3. The competent authorities of each of the Parties shall allow any crew member of any vessel of the other Party who is admitted to a hospital in the territory of the other Party to remain for the period necessary for treatment in the hospital.
4. Each of the Parties reserves the right to refuse entry into its territory to undesirable persons, even if such persons hold the travel documents provided for in Article (11) above.
5. The application of the provisions of this Article shall not affect the legislation of the Contracting Parties concerning the entry, transit, and stay of crew.
Article (13)
Incidents at Sea
1. If a vessel of one of the Contracting Parties is wrecked, runs aground, or is otherwise in distress while in the territorial waters of the other Party, the authorities of the latter shall provide the vessel's crew, its passengers, the vessel itself, and its cargo with the same protection and assistance as if the vessel were flying its own flag.
2. In the event of a maritime incident as described in the preceding paragraph, neither Party shall impose import duties, including consumption tax, on any of the vessel's cargo, equipment, materials, supplies, or other appurtenances, except for the use or consumption of such items in the territory of the Party concerned. The competent customs office branch must be notified of the maritime incident without any delay. The conditions relating to the storage and exemption from customs duties for the goods concerned shall be agreed upon.
3. Both Parties shall, upon request, and in accordance with the procedures followed under their applicable laws, cooperate with each other to ensure the safety of vessels and the protection of the marine environment, for which at least one Party is responsible for the investigation in accordance with Section (6) of the IMO Code for the Investigation of Marine Casualties and Incidents. If necessary, this cooperation aims in particular to facilitate the conclusion of agreements as provided for in this Code.
Article (14)
Technical Cooperation
The Contracting Parties shall encourage maritime transport companies and any other institution related to maritime transport of their States to develop all possible fields of cooperation, particularly in maritime classification, shipbuilding, ship repair and maintenance, ship recycling, maritime education and training on ships, maritime administration, port management, port construction, maritime safety and security, marine environment protection, and search and rescue.
Article (15)
Consultations
1. Either of the Parties or their competent maritime authorities may, at any time, request working visits or hold consultations with the other Party or its maritime authority.
2. Any working visits or consultations requested by either Party or its maritime authority must commence within a period not exceeding ninety (90) days after receipt of such a request.
Article (16)
Settlement of Disputes
In the event that any dispute arises between the Contracting Parties concerning the interpretation or application of this Agreement, the Contracting Parties shall seek to settle this dispute amicably through negotiations between the competent maritime authorities following a request for consultation.
Article (17)
Entry into Force
This Agreement shall enter into force thirty days after the date of receipt of the last written notification, by which the Contracting Parties shall notify each other of the completion of the internal procedures necessary for the entry into force of this Agreement.
Article (18)
Duration of the Agreement, Amendments, and Cancellation
This Agreement may be amended by mutual consent between the Contracting Parties through a separate protocol, which shall enter into force in accordance with Article 17 of this Agreement. It shall be an integral part of this Agreement.
Article (19)
Validity and Withdrawal
This Agreement is concluded for an indefinite period. Each Contracting Party may terminate the Agreement at any time by giving written notice of termination to the other Contracting Party through diplomatic channels. In such a case, this Agreement shall terminate six months after the date of receipt of the notice of termination by the other Contracting Party.
Done in Warsaw on 20 November 2019, in three original copies, in Polish, Arabic, and English, all texts being equally authentic. In case of divergence in their interpretation, the English text shall prevail.

Maritime Transport
The Government of the United Arab Emirates and the Government of the Republic of Poland Hereinafter referred to as the "Contracting Parties",
Without prejudice to existing legislation at both Contracting Parties and their obligations towards International Conventions in force, both Parties are desirous to sign the following "Agreement" for cooperation in maritime transport;
in the common interest of both Parties and desirous of providing a legal foundation for the reciprocal trading relations through shipping with a view to ensuring the freedom of foreign trade and enhancing, to the greatest degree possible, co-operation in this field; recognizing that the bilateral exchange of goods should be accompanied by an effective exchange of services based upon the principle of competition in service providing;
referring to the international conventions on the safety of navigation, the facilitation of international maritime transport, the living and working conditions of seafarers, the carriage of dangerous goods, and the protection of the marine environment among other concepts;
Have agreed as follows:
Article 1
Definitions
For the purposes of this Agreement, unless expressly provided otherwise:
1. Competent Maritime Authority" means:
With regard to:
a) The United Arab Emirates, the Federal Transport Authority Land & Maritime (FTA),
b) The Republic of Poland, the Minister of Maritime Economy and Inland Navigation.
2. "Vessel of the Contracting Party" means a vessel, which, in accordance with the regulations of such Contracting Party, flying its flag and has been entered in a register. and any vessel flying the flag of a third state and chartered/operated by a shipping company of one of the Contracting Parties, shall also deemed to be a "vessel of a Contracting Party" within the period of this charter.
3. "Shipping Company of the Contracting Party" means any legal entity which is licensed/authorized to carry out international shipping service with its owned and/or chartered vessels and has its headquarters or principle place of business in the territory of the State of either of the Contracting Parties.
4. "member of the crew" means any person who, during the voyage, has duties to perform services on board the vessel and whose name is inscribed on the crew list;
5. "Port of the Contracting Party" means any sea-port in the territory of the State of the Contracting Party, which is open to international shipping.
"Article 2
International Obligations
The present Agreement shall not affect the rights and obligations of the Contracting Parties arising from international conventions or bilateral agreement at regional or international level to which either of them is a Party, and also does not affect the obligations arising out of any other valid agreements or memorandums signed between the Contracting Parties.
Article 3
Freedom of Shipping; non-discrimination
(1) A vessel of the Contracting Party shall be entitled to sail to any of the ports in the territory of the state of either Contracting Party that are open to international trade and to carry passengers and cargo to the territories of the State of the Contracting Parties as well as to either of these and third state.
(2) The Contracting Parties without prejudice to existing legislation at both the Contracting Parties shall refrain from any action that might be detrimental to the unrestricted participation of the shipping companies of the Contracting Parties in
maritime transport the principles of non-discrimination, of free competition, and of the free choice of shipping company shall apply.
Article 4
Measures to facilitate maritime transport
The Contracting Parties shall take all measures necessary to facilitate and promote maritime transport, to avoid any unnecessary prolongation of lay times, and to simplify and expedite, wherever possible, customs and other formalities to be observed in ports.
Article 5
Equal treatment of vessels
1. On the basis of reciprocity, either Contracting Party shall grant the vessels of the other Contracting Party, when in its ports, territorial waters, or other waters under its jurisdiction, the same treatment granted to vessels of the most – favoured-nation treatment,
2. The provision of paragraph 1 of this Article shall also apply to access of vessels of the Contracting Parties to ports of the Contracting Parties, to collection of port fees and charges, to treatment during staying and departure ports, to the use of port facilities for transportation of cargo, as well as access to all other port services and facilities.
Article 6
Commercial activities
1. On the basis of reciprocity, either Contracting Party according to the rules applicable to the other Contracting Party, shall grant the shipping companies of the other Contracting Party the right to set up and maintain in the territory of its state, branches and representatives offices of their own for the exercise and use of agents' and forwarders' services as well as to enrol administrative, clerical, and technical personnel for these purposes.
2. The laws and other regulations of the host Contracting Party governing the entry of foreigners and their stay in the territory of the host Contracting Party, shall be complied with in the process of setting up the branches and representatives offices and the employment of the personnel.
3. Under the provisions of paragraph (2) of this Article, the domestic laws in force in the Contracting Parties relating to the entry and repatriation of foreigners shall remain applicable.
Article 7
Free transfer of funds
Either Contracting Party shall grant the shipping companies of the other Contracting Party the right to use any revenues from shipping services, including the management and conduct of initial or terminal haulage connected therewith, towards shipping-related payments. Alternatively, such revenues may also be transferred abroad, freely and without any restriction or delay, in any convertible currency at the official rate of exchange.
Article 8
Exemptions
1. The provisions of the present Agreement shall not apply to the following types of vessels:
1. Warships;
2. fishing vessels;
3. research vessels;
4. Vessels used by the government for non-commercial purposes.
2. The present Agreement shall not affect the laws and regulations of either Contracting Party concerning the privilege of the national flag with regard to national coastal navigation as well as to salvage, towage, pilotage, and hydrographic services, which are reserved for either Contracting Party's national shipping or other companies and for its own citizens.
Article 9
Compliance with legal provisions
(1) A vessel of either Contracting Party or her crew members, during their stay in the territory of the State of the other Contracting Party, shall be subject to the laws in force there.
(2) Passengers and consignors of goods shall comply with the laws and regulations in force in the territory of both Contracting Parties and governing the entry, stay and departure of passengers
(3) As well as the import, storage, and export of goods, including the provisions concerning shore leave, immigration, customs, taxation, and quarantine.
Article 10
Reciprocal recognition of vessels documents
(1) Documents for a vessel of either Contracting Party, which have been issued or recognized in accordance with relevant international conventions, shall be carried on board and recognized by the other Party.
(2) Vessels of either Contracting Party carrying a valid International Tonnage Certificate (1969) shall be exempt from further tonnage measurement in the ports of the other Contracting Party. In cases where the tonnage of the vessel is to be the basis for calculating the amount of any charges, fees, and taxes, the tonnage notation given in the International Tonnage Certificate shall be taken as such basis.
(3) Fees and expenses owed to the ports by vessels carrying two tonnage certificates with the provisions of the International Convention on Tonnage Measurement of Vessels,1969, port charges shall be based on the certificate of the highest tonnage.
(4) Vesselsof less than 24 meters in length, which are not subject to the International Convention on Tonnage Measurement of Vessels (1969) calculated their own fees under the national tonnage certificate issued by any of the Contracting Parties shall be considered.
Article 11
Travel documents of the members of the crew
(1) For the members of the crew, whether they are citizens of one of the Contracting Parties or of a third state, those travel documents issued by the competent authorities that may be used for border crossing under the national prerequisites of the
Contracting Party the border of which is to be crossed shall be deemed admissible border-crossing documents.
A) For the nationals of the Republic of Poland- Passport or the Seaman's book
B) For the nationals of the United Arab Emirates – Passport or the Seaman's book.
(2) The Contracting Parties shall exchange through diplomatic channels the specimen documents referred to in paragraph (1) of this Article, not later than thirty days following the day the present Agreement entry into force. Any change of such document shall be notified not later than thirty days prior to introduction of change thereof.
Article 12
Entry, transit, and stay
1. Each of the Contracting Parties shall allow the crew members of the vessel of the other Contracting Party who are holders of one of the documents listed in Article 11 of this Agreement and of the visa or another relevant document, if required, to go
2. Every crew member holding any of the documents listed in Article 11 of this Agreement and of the visa, if required, may pass in transit the territory of the State of the other Contracting Party for the following purposes:
1) Return to the territory of the home country;
2) Joining vessel;
3) For any other purpose recognized as justified by the Competent Authorities of the other Contracting Party.
3. The Competent Authorities of the Contracting Parties shall issue the stay permit to any crew member admitted to hospital in the territories of their States, for the period of time necessary for treatment.
4. Without prejudice to paragraph (3), the Contracting Parties reserve the right to refuse entry into the territories of their States of undesirable persons, also in those cases when such persons hold any of the documents listed in Article 11 of this Agreement and the visa, if required.
5. The provisions of this Article shall not affect the legislation of the States of the Contracting Parties in respect of entry, transit, stay and departure of foreigners.
Article 13
Incidents at sea
1. Should a vessel of one of the Contracting Party suffer from an accident or encounter any other danger in the area of internal waters or in the territorial sea of the State of the other Contracting Party, the Competent Authorities of the other Contracting Party shall take all the measure necessary to render help and assistance to crew members, passengers, the vessel and cargo, to the same extent as in the case of a vessel flying that Contracting Party's flag. Whilst determining the causes of maritime accidents, the Contracting Parties
shall comply with the principles set out in the provisions of the International Maritime Organisation (IMO) Casualty Investigation Code.
2. The Competent Authorities of the Contracting Party, in whose internal waters or territorial sea a vessel of the other Contracting Party has suffered from an accident or encountered any other danger referred to in paragraph 1 of this Article, shall notify, as soon as possible, the event to the nearest consular office of the State of the other Contracting Party.
3. The provisions of this Article shall not limit the rights to claims in respect to sea rescue and salvage services, assistance and help granted to a vessel, its passengers, crew and cargo.
Article 14
Technical Co-operation
The Contracting Parties shall encourage maritime transport companies and any other institution related to maritime transport of their States to develop all possible fields of co-operation, in particular in the ships' classification, shipbuilding, ship repair and ship maintenance and ship recycling, maritime education, maritime administration, port management, port construction, maritime safety and security, marine environment protection and search and rescue.
Article 15
Consultations
(1) Either Contracting Party or its competent maritime authorities may request, at any time, working visits or consultations with the other Contracting Party or its maritime authority.
(2) Any such working visits or consultations requested by either Contracting Party or its maritime authority should begin within a period not exceeding ninety (90) days following the receipt of such request.
Article 16

Article 17
Entry into force of the Agreement
This Agreement shall enter into force thirty days after the date of the receipt of the last written notification, by which the Contracting Parties shall notify each other on the completion of internal procedures necessary for the entry into force of this Agreement.
Article 18
The provisions of this Agreement may be modified and amended by a mutual consent of the Contracting Parties, which shall be formed as a separate protocol and enter into force
in accordance with Article 17 of this Agreement. Protocols formed thereby shall constitute an integral part of this Agreement.
Article 19
Duration and Denunciation
This Agreement shall be concluded for an indefinite period of time. Each Contracting Party may terminate the Agreement at any time by giving a written notice of termination to the other Party through diplomatic channels. In such a case, this Agreement shall expire six months after the day of the receipt of the termination notice by the other Contracting Party.

AGREEMENT
BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF POLAND
AND
THE GOVERNMENT OF THE UNITED ARAB EMIRATES
ON MARITIME TRANSPORT
The Government of the Republic of Poland and the Government of the United Arab Emirates, hereinafter referred to as the "Contracting Parties",
without prejudice to the provisions of the existing legislation of both Contracting Parties and the obligations under the international agreements binding on them, wish to sign this Agreement on maritime transport,
having regard to the mutual benefits of both Contracting Parties and the establishment of a legal basis for the development of mutual commercial cooperation in the field of maritime transport, in order to ensure freedom in foreign trade and to strengthen, to the highest possible degree, cooperation in this field; recognizing that the bilateral exchange of goods should be accompanied by an effective exchange of services based on the principles of fair competition,
taking into account, inter alia, the provisions of international agreements concerning maritime safety, facilitation of international maritime transport, social living and working conditions of seafarers at sea, carriage of dangerous goods, protection of the marine environment,
have agreed as follows:
Article 1
Definitions
For the purposes of this Agreement, unless provided otherwise, the terms used mean:
1) "competent authorities of the Contracting Parties":
a) in the Republic of Poland – the Minister of Maritime Economy and Inland Navigation,
b) in the United Arab Emirates – the Federal Transport Authority - Land & Maritime (FTA);
2) "vessel of a Contracting Party" – any sea-going vessel entered in the ship register in accordance with the laws in force in the territory of the State of a Contracting Party flying the flag of that State and any vessel flying a foreign flag chartered / operated by shipping companies of the Contracting Parties and during such charter / operation considered as a vessel flying the flag of the State of one of the Contracting Parties;
3) "shipping company of a Contracting Party" – a legal entity registered in the territory of the State of one of the Contracting Parties in accordance with the applicable laws of that State, authorized to conduct international shipping with its own and/or chartered vessel, having its seat or place of residence in the territory of the State of that Contracting Party;
4) "crew member" - any person who is employed on the vessel during the voyage and is entered on the crew list;
5) "port of a Contracting Party" – any sea port located in the territory of the State of a Contracting Party, open to international shipping.
Article 2
International Obligations
This Agreement shall not affect the rights and obligations of the Contracting Parties arising from international conventions or bilateral agreements binding on them, at both the regional and international levels, nor does it affect the obligations arising from other mutually binding agreements or understandings signed by both Contracting Parties.
Article 3
Freedom of Navigation and Non-Discrimination
1. A vessel of a Contracting Party has the right to call at any of the ports of the other Contracting Party open to international trade, and to carry passengers and cargo between the territories of the States of both Contracting Parties, as well as between each of them and third countries.
2. The Contracting Parties, without prejudice to their legal provisions, shall refrain from any actions that could harm the unrestricted participation of the shipping companies of the Contracting Parties in maritime transport based on the principles of non-discrimination, fair competition, and free choice of shipping companies.
Article 4
Facilitation of Maritime Transport
The Contracting Parties shall take all necessary measures to facilitate and promote the development of maritime transport to avoid unnecessary extension of vessel stays in ports, and, as far as possible, to simplify and expedite customs formalities and all other formalities applied in their ports.
Article 5
Equal Treatment of Vessels
1. Each of the Contracting Parties, on the basis of reciprocity, shall grant to the vessels of the other Contracting Party in its ports, territorial sea, or other waters within its jurisdiction, the same treatment as is provided for vessels of the most-favoured-nation.
2. The provisions of paragraph 1 of this Article also apply to access to the ports of the Contracting Parties, the collection of port taxes and fees, treatment during stay in and departure from ports, the use of port facilities for the transport of goods, as well as access to all other port services and facilities.
Article 6
Commercial Activity
1. On the basis of reciprocity, each of the Contracting Parties, in accordance with the law applicable to the other Contracting Party, shall grant to the shipping companies of the other Contracting Party the right to establish their own representative offices and branches in the territory of its State for the purpose of providing shipping agency and freight forwarding services, as well as to provide administrative and technical support for this purpose.
2. The establishment of representative offices and branches and the employment of personnel for this purpose shall be in accordance with the applicable laws of the host Contracting Party regarding the entry and stay of foreigners in the territory of the host Contracting Party.
3. In accordance with the provisions of paragraph 2 of this Article, the applicable domestic law of the Contracting Parties relating to the entry and exit of foreigners shall apply accordingly.
Article 7
Transfer of Revenue of Shipping Companies
Each of the Contracting Parties grants to the shipping companies of the other Contracting Party the right to use revenues from maritime transport services, including loading and unloading of the vessel and related management, for payments related to maritime transport. Such revenues may also be transferred abroad without any restrictions or delays, in any officially convertible currency, at the official exchange rate.
Article 8
Fields Excluded from the Scope of the Agreement
1. The provisions of this Agreement do not cover the following types of vessels:
1) naval ships;
2) fishing vessels;
3) research vessels;
4) state service vessels used for non-commercial purposes.
2. This Agreement does not affect the laws of the Contracting Parties concerning the privileges of their own flag in cabotage, salvage, towage, pilotage, and other hydrographic services related to maritime transport reserved for the shipping companies of each of the Contracting Parties or other enterprises, as well as for the citizens of the State of that Contracting Party.
Article 9
Compliance with Applicable Laws
1. Vessels of one Contracting Party, as well as their crews, while in the territory of the State of the other Contracting Party, shall be subject to the relevant laws in force in the territory of that State.
2. Passengers and freight forwarders are subject to the laws and regulations in force in the territory of both Contracting Parties concerning the entry, stay, and exit of foreigners.
3. The above rules apply accordingly to the import, storage, and export of goods, which are subject to regulations concerning the temporary stay of crew members, immigration, customs, taxes, and sanitary regulations.
Article 10
Mutual Recognition of Ship Documents
1. The documents of a ship of each of the Contracting Parties, issued or recognized in accordance with the relevant provisions of international agreements, located on board, shall be recognized by the other Contracting Party.
2. Ships of each of the Contracting Parties holding a valid tonnage certificate issued in accordance with the International Convention on Tonnage Measurement of Ships of 1969 shall be exempt from re-measurement in the ports of the other Contracting Party. In the event that the tonnage of the ship is the basis for the calculation of the amount of any fees, taxes, and charges, the tonnage capacity indicated in the tonnage certificate shall be taken as the basis for their calculation.
3. Ships holding two tonnage certificates in accordance with the provisions of the International Convention on Tonnage Measurement of Ships of 1969 shall pay
port fees and charges on the basis of a measurement certificate indicating a higher tonnage.
4. For vessels under 24 meters in length, to which the provisions of the International Convention on Tonnage Measurement of Ships, 1969, do not apply, the calculation of port fees and charges shall be based on national tonnage certificates issued by one of the Contracting Parties.
Article 11
Identity Documents of Crew Members
1. Each of the Contracting Parties shall recognize the official identity documents of crew members, who are citizens of the States of the Contracting Parties or of a third state, issued by the competent authorities, entitling them to cross the state border in accordance with the requirements of the national legal regulations of that Contracting Party whose border is to be crossed. These documents are as follows:
a) for citizens of the Republic of Poland – a passport or a Seaman's Book,
b) for citizens of the State of the United Arab Emirates – a passport or a Seaman's Book.
2. The Contracting Parties shall exchange, through diplomatic channels, specimens of the documents referred to in paragraph 1 of this Article, no later than thirty days after the date of entry into force of this Agreement. Any changes to these documents shall be notified no later than thirty days before their amendment or introduction.
Article 12
Entry, Transit and Stay
1. Each of the Contracting Parties shall permit crew members of a vessel of the other Contracting Party, holding one of the documents listed in Article 11 of this Agreement and a visa or other appropriate document, if required, to go ashore and stay within the port city for the duration of the vessel's stay in the port of the Contracting Party, in accordance with the relevant legal provisions in force in that State.
2. Any crew member, holding one of the documents listed in Article 11 of this Agreement and a visa, if required, may transit through the territory of the State of the other Contracting Party for the following purposes:
1) to return to the territory of their own State;
2) to join a vessel;
3) for any other purpose deemed justified by the competent authorities of the other Contracting Party.
3. The competent authorities of the Contracting Parties shall issue a residence permit to any crew member who has been admitted to a hospital in the territory of their State, for the period of time required for hospital treatment.
4. Without prejudice to the provisions of paragraph 3, the Contracting Parties reserve the right to refuse entry into the territories of their States to undesirable persons, even in cases where such persons hold one of the documents listed in Article 11 of this Agreement and a visa, if required.
5. The provisions of this Article shall not affect the legal regulations in force in the territory of the States of the Contracting Parties concerning the entry, transit, stay, and departure of foreigners.
Article 13
Maritime Accidents
1. If a vessel of one Contracting Party is involved in an accident or is in any other dangerous situation in the internal maritime waters or the territorial sea of the State of the other Contracting Party, the competent authorities of the other Contracting Party shall take all necessary measures to provide assistance and care to the crew members, passengers, the vessel, and its cargo to the same extent as would be provided to a vessel flying the flag of the State of that Contracting Party. When establishing the causes of maritime accidents, the Contracting Parties shall adhere to the principles set out in the provisions of the Code for the Investigation of Marine Casualties and Incidents of the International Maritime Organization (IMO).
2. The competent authorities of one Contracting Party, in whose internal maritime waters or territorial sea a vessel of the other Contracting Party has suffered an accident or found itself in a dangerous situation, in accordance with paragraph 1 of this Article, shall immediately notify the nearest consular office of the State of the other Contracting Party of this event.
3. The provisions of this Article shall not prejudice the rights to claims arising from maritime search and rescue, care, and assistance provided to the vessel, its passengers, crew, and cargo.
Article 14
Technical Cooperation
The Contracting Parties shall encourage maritime shipping companies and other institutions related to maritime transport of their States to develop all possible forms of cooperation, particularly in the fields of ship classification, shipbuilding, repair, maintenance and scrapping of ships, maritime education, maritime administration, port management and development, safety and security of maritime navigation, protection of the marine environment, and maritime search and rescue.
Article 15
Consultations
1. Each of the Contracting Parties or its competent maritime administration authorities may at any time request working visits or consultations with the other Contracting Party or its competent maritime administration authorities.
2. Such working visits or consultations shall take place at the request of either of the Contracting Parties or its competent maritime administration authorities within a period not exceeding ninety days after the date of receipt of the said request.
Article 16
Settlement of Disputes
Any disputes arising from the application or interpretation of this Agreement shall be settled amicably through negotiations by the competent maritime administration authorities of the Contracting Parties, after considering a request for consultation.
Article 17
Entry into Force of the Agreement
This Agreement shall enter into force thirty days after the date of receipt of the later written note through diplomatic channels, in which the Contracting Parties shall inform each other that the conditions required by the internal legislation of their States for the entry into force of this Agreement have been fulfilled.
Article 18
Amendments
The provisions of this Agreement may be amended by mutual agreement of the Contracting Parties, in the form of separate protocols, which shall enter into force in the manner established in Article 17 of this Agreement. Such protocols shall form an integral part of this Agreement.
Article 19
Duration and Termination
This Agreement is concluded for an indefinite period. Either of the Contracting Parties may terminate this Agreement at any time by giving written notice through diplomatic channels to the other Contracting Party. In such a case, this Agreement shall cease to be in force six months after the date of receipt of this notice by the other Contracting Party.
This Agreement was done in Warsaw on the 20th day of November 2019, in two originals, each in the Polish, Arabic, and English languages, all texts being equally authentic. In case of divergence in their interpretation, the English text shall prevail.
